Being overtaxed by employer

in Cutting tax
When I started at my new company in February, I hadn't closed down my previous employment, so I filled in a P46 and ticked the 2nd job box.
However, from when I started at this company, I have not received any money from my previous employer, but have been taxed on 20% of my entire income at my current position even know it is my only job.
I have updated HMRC with my new details, and have a P45, but my new company will not accept it as it is from the previous tax year.
HMRC also say that they have sent my tax code to my current employer, but my current employer is denying it. They will also not accept me handing my copy of my coding notice.
What can I do? I cannot afford to live on what I am getting after all this tax is taken off, and are resorting to using credit cards to make ends meet.

Have you made a formal complaint in writing to HMRC?0 -
Not in writing as of yet, been calling them almost every week since March though. I will try that. Thanks.0

Who's in the wrong here? HMRC or OP's new employer? The acquisition of wealth is no longer the driving force in my life.0

I have advised both of the situation, both are just non stop passing the buck. HMRC are convinced they have known about the situation from day 1 and are sending coding notices to my employer, my employer is saying they still think I work for another company, even know i don't and have told them this many times.
I still don't understand why I cannot just give them my coding notice.0 -
The employer is denying having received the code - presumably the employer's payroll department have tried to clarify this with HMRC with no success?
It seems to me that a formal complaint must be made to HMRC either by the OP or his employer? In the OP's position (as the one most affected by the mix up), I'd make the complaint myself.0 -
Didn't you get a copy of your new tax code notice? OK, your new employer probably won't accept it as gospel, but at least it tends to confirm that HMRC sent the employer's copy as well.
A thought: when HMRC say they sent it to "your employer" - which one do they mean? I almost forgot that we are dealing with people who have raised the humble c*ck up to the level of an art form. The acquisition of wealth is no longer the driving force in my life.0 -

I did yes, I did offer this to my employer, but just got told that they can only accept a P45.
When I provided the P45, they rejected it as it is from last tax year, even know I only got this P45 in May this year.0 -

a P45 for last tax year is indeed no use
check with HMRC they have the correct name and details for your employer
have you checked you tax for taxyear 2011-12 to ensure that is correct?0 -
HMRC tend to notify employers online now (not by post) of tax codes and other PAYE matters. Ask your employer if they have actually checked their online notifications for new tax codes recently.0

In respect of the tax year 2011-12, the quickest way to crystallize any tax overpaid is to print off and submit a self-assessment form, together with the relevant payslips from both employments and any P60s you may have received. Although HMRC are entitled to collect or repay amounts of + or - £2,000 through the tax code of the next year, it would be uncommon for them to refuse a repayment in cash to a non-director if requested to do so in writing.
It would be worth attaching a letter to HMRC stating that you wish to receive a copy of your tax code that is being sent to your employer whose employer tax reference is (in the format) 246/A2468 (you should be able to find this on your payslip), explaining that you are trying to ensure that you are being taxed in the current tax year under the correct tax code.
