Do I Need To Repay
After trying to increase my mortgage I was made aware of some adverse credit. After being the victim of ID fraud I was very worried. I Obtained a credit report which shows that this is from a genuine loan I took out. I got in to financial bother owing money all over, but I sold my flat and paid off everything. Or so I'd thought!!
This loan was with Lloydstsb. I had instructed the bank to pay through direct debit I have a letter stating the loan has been repaid. However when I contacted Lloyds they informed me that my bank (also Lloydstsb) had cancelled it and since then, they have been trying to re-take the payment, but there are insufficient funds. I have not recieved any correspondence from them in the year 20 months since this happened but I have moved, around 4 months after I thought I had paid. I was not obliged to tell them I had moved because I assumed the debt was paid, and the bank does have my change of address although the loan side of the company seem not to, strange.
To be honest I do recall the bank cancelling this possibly because I instruced them to. This is not because I was not intending to pay, the funds were there but I can't recall the exact circumstances, I think I had phoned up the early repayment line and thought I'd paid using my card, so didn't want to pay twice. I also had so much going on at the time and countless things being paid that I obviously did not see that this amount had not come out.
The loan side of Lloydstsb have adviced me to contact my bank becuase they cancelled this. Where do I stand? I am sure I will not be liable for any interest and default payments as I have not been contacted, however am I still liable for a loan for which I have a letter stating it has been paid, but that the company should be able to evidence has not been form my Lloydstsb account anyway.
