Stressed and Distressed

I went BR in Sept 2008 and discharged in Feb 2009.
2009 saw me debt free, living in a private rented flat aka squalid flat so when I was offered a place in a Extra Care Sheltered place, newly built I grabbed the opportunity with both hands/feet and moved in Oct 2010, only debt was a £93 electric bill from squalid ex rental place.

I soon realised I'd made a huge mistake, although the £190 a week rent was covered by HB and council tax too, the Well Bieng Chargevwas not, this was £38 a week and I only got £105 a week, with a £5 deduction for CSA and £8 a week for a Budgeting Loan they gave me to help with removal expenses etc.

TV licence was supposed to be covered it wasn't, Water Rates included first few months then they started charging for that through the water meters, Laundry was originally free to use then they put coin mechs on so you had to pay.

The all electric fancy heating system was horrendous to pay for, really made a horrible mistake moving in there.
All the activities provided had to be paid for and I soon ran up debt there

Long story short after virtually threatening to kill (im bi polar was doing brilliant before I moved in there)myself they gave me a one bedroomed bungalow so so much cheaper affordable.

Stupidly whilst living at that scheme I have ran up a £2500 bill on that Well Bieng Charge, debts with Provident Brighthouse and DFS for a sofa, my rent act is clear and gas and electric all up to date so is council tax.

Bi polar I've managed to get back under control, I see a psychiatrist 3 monthly have a CPN who I see every two weeks it's just this debt that's hanging over me.

I have about £8854 of debt, am thinking BR again, my sister said she would help pay BR fees.

Can I go BR twice? Fully expect BRO/U or maybe a DRO, I'm not sleeping,blood pressures through the roof, my health is bad and I just need to sort this out,my life is awful, frightened to answer the phone/door, read the red letters and ignore them.

Now realise I have to do something, so can you go BR twice.

Please no lectures, I'm fully aware of the stupid mess I have gotten myself into, I am 55 unemployed, single and well aware what a idiot I've been.

  • I don't know if you can go bankrupt twice, but I do know you are not an idiot. You have real mental health issues that contribute to the difficulties you find yourself in, and you are not alone in those. Can your Cpn refer you for help with your finances?

    To the best of my limited knowledge you can go bankrupt more than once. Seek advice from your local CAB. All the best.

    Yes, you can go BR more than once. If there is less than (I think 6 years) a certain amount of time you are likely to be placed under a BRO.

    As has been said, you can go bankrupt again.

    Your case is likely to be looked at more closely - the OR will be concerned you are not using repeated bankruptcies to live beyond your means.

    Your post suggests you can show that you are not.

    A debt relief order may be a cheaper option for you than bankruptcy but I would suggest you contact someone such as consumer credit counselling service http://www.cccs.co.uk/InfoCentre/EnglandandWales/Debtsolutions/Bankruptcy.aspx or perhaps your local cab or community legal advice centre for free and independant advice on this

  • Hi Suzie, have you still got a copy of your tenancy agreement? If so I would have it looked at by some kind of housing welfare charity as it seems like you have been short changed. Even if this ends up being legal, it does not nessesarily make it ETHICAL. It must have been so tough for you having increases in your budget so unexpectedly.

    I do wish you the best though, I understand completely the stress of debt it can really hurt both physically and mentally. Make sure you always have your sister or a witness when an official is reading a document to you, this way you will have a second pair of ears and eyes if possible. hugs girl :)

    Ok, when the chap comes sort out your benefits but talk to the National Debtline or CCCS ( they may give you an appointment when they will ring you back) then tell the chap that you are taking advice from NDL or CCCS and have an appointment to discuss your money problems and when you have been advised properly then someone will call him and sort something out. Don't sign anything to do with your debt until you have taken advice.

    Well done on today, glad you managed to get the HB etc. paperwork signed. Also good on you for being strong and not just signing any other paperwork.

    If you are eligible for a DRO then why not go for it? £90 compared to £700!

    I am on my phone and can't post links but if you go to the LOOK HERE FIRST: Bankruptcy Help sticky there is a list of letters from NDL and should be one on there you can use.

    Pop over to the IVA&DRO board and they should be able to help you source a company registered to administer a DRO, it has to be a proper registered comp. They will be able to help you with any questions you have as well.
