Gym Membership CCJ Worry

I joined a Gym at christmas as they had an offer on for a free month trial then £27 per month. I used the free month and paid for one month extra use then canceled the membership as I decided it wasnt worth it. 6 months later I am being called by a credit collection agency for my unpaid fees, so i fished out the agrement and notice the form has writen on it that I cannot cancel before december 2012. I was never told this when I signed up and the form was blank when i filled it in signed it and handed it back only then did they write on that I have subscribed to a minimum term so im refusing to pay as I belive I was misslead. The thing that worries me is the prospect of a CCJ. Firstly they have only called me they have never sent any letter to my address, can they get a CCJ against me without first writing to me? secondly I read that if you pay a CCJ before the court date or within 28 days of the Judgment then it does not get recorded is this true?
