Triton- advice needed (a little long)

I have been on incapacity benefit for 2 and 1/2 years. All my creditors froze the interest and accepted £5 token payments, except Triton who bullied me into £6.88 (a mistake, I now know).
Well last september I sent them the SOA they requested but missed a couple of details of exactly how much I owed two other creditors, as I didn't know and my mental health was too bad to allow me to find out. In November they wrote to me. I phoned them found out exactly what info they needed and wrote to them. They have since failed to recieve 3 letters until having come here I sent one recorded delivery last week. They are now using only the info on those two creditors to work out pro rata payments and want £27.
I phoned them and dealt with a very rude woman.
I calmly told her that:
£6.88 was all that I could afford
The advice of payplan was that this was reasonable.
That a court would make higher allowances for food and clothing etc than I currently claim and while I knew they would not ask me to pay more they might find a lower payment reasonable.
That I sadly concede that if they wish they can take me to court and I will be able to handle this ( knowing my legal rights)
That it seems to me that they are trying to be seen as a preferential creditor which is unreasonable.
That their inability to recieve, process and deal with information provided reasonably and promptly. Their constant slightly threatening tone in letters and the rudeness and raised voices from staff was unprofessional, and that as this didn't help my recovery, I was going to seek advice about which body is in place to govern and moderate their actions.
I asked to speak to a manager but none was available and I obviously wouldn't give a phone number. So I said I would continue to make payments of £6.88 and they could act as they saw fit and terminated the call.

It's a good job I am having a good couple of days emotionally, mentally and physically. Otherwise I would be falling apart.

So, after all that the question is:

Have I said/done anything unreasonable above, given that I have always taken responsibility for my debt and want to pay all my creditors? And is there anything else I should have done/ should do? I have as always recorded (on paper) full details of the conversation and the person I dealt with.

  • If they want to take you to Court then let them.

    They will find that the Court may award them their debt at £1 per month!

    Tesco took me to Court over £14K, whilst I was awaiiting an IVA - the Court awarded them £1 per month!

    These callers are only trying to scare you into paying up.

    Just ignore them


    Actually, given your debt and your circumstances you would be better off going bankrupt.

    If you have no house or other major asset to preserve it would be worth a thought

    Thanks, that was pretty much what I figured.

    I'm reluctant to look at bankruptcy because I do have a small house, teenage sons and a tendency to agrophobia. This is my safe space and even an slight chance of a threat to it sends my anxiety level soaring (even more than a triton employee :) ).Having talked to both CAB and payplan they seem to agree my current approach is a reasonable one.

    Wescot credit used to try that kind of thing with me ... they would agree to the pro-rata amount on my SOA and then say they could only accept it for 3 months. They said it would take an unreasonable amount of time to repay it at the rate I do. I contacted them saying that my circumstances were unlikely to change and that was the payment worked out by CAB pro-rata with my other creditors. They accepted it and I haven't heard from them since.

  • If they find out that you own the house they may even go after it and try and get a charging order on it !!! Anyway if they goto court then they will look really stupid when the judge turns around and orders you to pay them £1 per month. Cant see what they would do then? Can you?

    Trton are still being !!!!!!. Keep hassling me to increase my payments. Today I phoned them and they asked me to confirm my phone number as a security question. They are not supposed to have or use my number so I assume that they just want to get hold of it. Idiots, if they think I am going to fall for that.
