Hoping someone can help me with this as I'm so scared
Basically, back in 2005, when I was still a teenager, I took out credit with a catalogue, I can't even remember which one...think it was Freemans or Littlewoods or something. The amount was £133.I made a few payments, then went off to Uni, and just forgot about it. I know it was stupid but I was young and stupid at the time. I didn't hear any more of it so just forgot the whole thing.
Fast forward a few years. In 2009, I left a good job to look after a relative that was critically ill and diagnosed with a brain tumour. I lived on savings for a bit, then eventually went onto carers allowance. At this time I got a letter from Bryan Carter solicitors, about the catalogue debt. I started paying £20 a month, and paid about six instalments.
BC then started ringing me and saying that I had a CCJ and had to pay £50 a month. At the time my income was £360 per month, so £50 was a lot to me. I told them I couldn't afford it, but they maintained that I had to pay £50. I paid one payment, but then didn't pay again because I just could not afford it.
During that time, I had to move house due to my relatives requirements for a downstairs room etc. During the house move, I lost the receipts for the payments I made to BC. I think I may have a couple of payments on bank statements, but mostly paid via a payment card.
I didn't hear anything after that, and I told BC that I would pay but only what I could afford. I also checked my credit file and discovered BC where lying about the CCJ, there was none recorded.
Today I got a claim form for a CCJ, from BC for the full amount of £133, plus court costs and solicitors fees, taking the total to around £200. I don't know what to do. I really can't afford to pay anything else out, I have other debts as it is. When I left my job to become a carer I took an income hit of over £20,000 and still have to pay debts I had before my situation changed, aswell as day to day expenses which is very very difficult on £360 a month. I'm just barely surviving as it is. I can't afford to pay the £200 now, although I may ask to borrow the money from family if it would mean a CCJ would not be recorded.
Does anyone have any advice on this? Any help appreciated x

Just fill in the form and return it. Don't be afraid of the ccj, the court will accept considerably less than £50pm and the DCA will no longer be able to contact you without it being classed as harassment.
If you have other debts, you should contact a free debt help agency, there are many listed on this site. They will deal with your creditors for you, are completely non judgemental, they've heard it all before, and really will take the strain from you and you will feel much much better.I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.
Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.0 -
So far you have paid around £170 off a £133 debt and they now are applying for a CCJ. Get your old bank statements and hopefully there will be proof on there that you have paid. Fill in the form that you intend to defend the claim and then send BC a SAR with £10 for all the information they hold on you.Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0

Hiya, thank you for your advice. I've been through my bank statements online and could only find a couple of payments as the online statements only go back to 2010 and I can't find my old paper statements. I was thinking about asking Bryan Carters for a detailed list of what I've paid but will they do that do you think? I know from experience they are ridiculously dodgy and liars. I wish I'd kept the receipts but at the time, with my relative so ill I didn't focus on anything else and let it all slide. Hope you don't mind asking but what's an SAR? Thanks0 -

Subject Access Request - they have to give you all the info they have on you including payments made.Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0
