Tax Credits

Can I have a tax credit over payment taken into my BR? The tax credits contacted my child care for an average child care cost over a number of years and has left me with a bill of £4700.Putting my hands up it was caused by me burying my head and not keeping a check on my ever changing child care arrangements. I currently pay £118 every 4 weeks which is automatically deducted from my tax credits.
I don't think it will affect me in too great a way as if I do get to put it into the bankruptcy then I would probably pay it into an IPA as I am guessing my tax credits would go back to normal and put my income up.
I know I need to go see CAB I have got some forms from them but cant quite face filling them in and make that appointment. Everything is so daunting.
Thanks in Advance again

As long as you had formal notification of the overpayment before your bankruptcy date, then yes, it does get covered by your BR.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I have an O/P wtc and was told by them it doesnt go into a b/r, are they wrong?? I was told that because its an on going claim they can take it of me, I also appealed and was turned down, if this is right Fermie I will go back to them. Thanks0

Hello Jayne60.
Fermi is absolutely correct, overpayments would usually be included within a bankruptcy. The only recent change is to do with social fund and crisis loans, these no longer would be included.
Best wishes,
