Early discharge

I will try to keep the story short that lead up to my bankruptcy order and will give an idea of hopefully helping me towards a discharge.
In 2008 I was clipped by a train at work caused by negligence from the signallers who control where trains should be, sadly for me the person in question did not see the train on his screen and this error caused the accident, this lead to 6 months off work with no pay.
For 6 months I battled against rent and bills and everything else under the sun but eventually I lost my battle against my rent,bills,living etc and under the advice of a representative of an advice line they informed me that bankruptcy was the only option ( because I was told I would never get back on track from what I owed and earned ).
I want to know if I can appeal to have an early discharge because of the reasons above, if I can what can I do about it ? I lost everything and if I had the sense to come on here before this I could of made some effects to have a normal financial life.

    Any early discharge will be decided upon by the OR so there is no process to allow you to apply for one. However there's nothing to stop you asking if an early discharge would be likely in your circumstances.

  • In 2009 was when I declared bankruptcy..... I had been screwed well and truly by the system because my solicitor has told me that I should of been kept a float by the insurance I pay within the industry and my house should of been saved by the government under some form of scheme

    Then you will have been discharged by now. BR is a year not 3 years. Have you checked whether you are still on the insolvency register?

    Possibly attero means by early discharge that they are tied in to an IPA, you can only be released from this early if your income/expenditure changes. Or possibly discharged was delayed from the normal one year due to suspicious circumstances or non-cooperation. Think Kerry Katona.

  • I was told that it was for 5 years by the guy I stood in front of when declaring bankruptcy. I said that I thought it was a year and he said no due to the volume of bankruptcies its going to be 5 years
    so what about my financial record what happens to that upto now I am not expecting it to be decent but am I still scored as a bankrupt ?

    Have you checked if you are still on the insolvency register like tigerfeet suggested?

    You should be discharged after a year, but the bankruptcy will remain on your credit files for 6 years from date you went bankrupt.

    You should order your statutory reports from all three credit reference agencies and follow the cleanup thread so that the records show the correct dates so they will fall off at the same time your bankruptcy does.
