Moving from one trust to another (NHS) Annual leave entitlement

Hi

I'm about to start employment with a new NHS trust within about the next 6-8 weeks (I don't as of yet have a start date).

I have been working for my current trust for 3.5 years. My annual leave entitlement is 28 days plus 8 bank holidays (9 this year) starting from April 2012 -April 2013. I work full time 37.5 hours a week.

When I leave I will have taken around 20 days annual leave already.

I've rang HR, Payroll and Recruitment of both trusts to enquire about this and not really got a definitive answer.

What I'm wondering is: When I leave will this just transfer over to my new trust or will I owe it to my current trust if I'm over my entitlement? If I am, is there a way I can then take annual leave with the new trust but work it or something in order to pay back what I owe?

Any help I will be very grateful for.

Thanks

When you leave your current trust you should be paid for any untaken entitlement owed to you and then you start to earn entitlement when you start your new job. When does your currant holiday year run from to?

As above: April - April with the tax year, but I will have taken 20 days by end of august which is only 4 months of the tax year

The leave year is normally April - March. Since your leave is applied in advance, you may find come exit you have taken too many a/l therefore be subject to clawback from your final pay.

yes April-March that's it. Owing money is what I'm worried about, you'd think it'd just transfer as I'm still working for the NHS which essentially is one company, silly that moving to another trust doesn't work like this

The NHS is made up of very many employers. It is not one organisation.

You are lucky in that your years of service count towards increasing holiday entitlement and so on.

Your current employer has one pot of money to pay for staff and your new Trust has a completely separate pot. They do need to account for paying your holiday in proportion to the amount of holiday earned in each.

What you will transfer over is leave entitlement, after 5 years NHS service you get more annual leave and even more after 10 years, you already have 3.5 years so only need 1.5 before you get 29 days.
