Bankruptcy and sold Mobile On Contract

Hi please dont flame me but

Can some one help please

The story is i lost my job and had just got a iphone contract i rung the provider up and tried to return the iphone as i lost my job and couldnt afford to pay for it and they refused. We got further and further into debt so i sold my iphone that was in a contract to pay some of the debts off

Now i have been told that that i cannot have a DRO because of this, i can go backrupt at the cost of £750 but the mobile contract may not be included in the bankruptcy as i no longer have the phone

Can some one advise please

Maybe not my best move selling the phone but i had no other choice

    Did you get the phone free or have to pay anything towards it? If you paid even £1 then why should the fact you have sold it matter.

    how long have you had the contract??

    and WHO says you cant apply for a DRO?...and whoever said you cant include a mobile contract debt etc is talking out their behinds!
    ANY debts you have before bankruptcy would be included (apart from a few excluded which yours ISNT!)

    No it was free with a 24mnth contract i tried to return it but as i had taken it out of the box i couldnt return it ive not even made 1 phone call on the contract

    It was the cccs told me that it wasnt worth doing a DRO as it would get rejected and that even if i went bankrupt it might not be added to the bankruptcy because i sold the phone and not given them any money back

    CCCS are talking daft about bankruptcy! but again WHEN did you take the contract out & who's it with??

    try speaking to national debtline or the CAB you'll probably get someone who can talk more sense then

    as far as im aware you pay for air time not the phone. i had iphone debt that went in br but,they never asked for the phone back. mind you mine was only a 3g and a yr old.
    as for a dro is or total debt over £15k?
