Reposession Looming

Hi Guys and Girls

Need a bit of help and advice.

I went bankrupt in November 2010, came out of bankruptcy in November 2011, was paying all my bills till January 2012, then unfortunately was told to go on the sick.

Was on the sick till April when I was deemed by the Job Centre Nurses that I was fit for work.

The mortgage company received a few payments from the DWP, they are not the ones seeking possession

My Landlord the ground rent people are taking me to court for possession for a debt of £178

Their invoice was due on the 1st of January, for this current year.

After all fees and costs associated this debt is now up to £1400 :-) in 6 months. I offered them a payment in April when the DWP gave me extra month to pay towards these costs. But they refussed on the grounds that action was already being taken.

So 4 months into a ground rent debt, and the landowner is now after possession,

What should I take to court with me for my defence?

I have already disagreed with the debt amount due to high fees and charges, Ive got the fact I offered them a payment which they refused, and ive put in about debt only being 6 months old, out of the current period.

Any help would be great as I know I am going to loose my home eventually, just trying to hold the wolves from the door.

    Hi Rick,

    Without understanding all the details of your property commitments it's very difficult to offer any comprehensive or detailed suggestions, but some things never change in a court of law. Namely, if you can demonstrate and have documentary evidence to prove that you've done everything possbile to keep the case from court the Judge / Recorder will take a very dim view of aggresssive legal action by the landowner.
