Letter advice

Since getting into a mess with my debts, I'm almost on top of it all and have payment plans in place with all except one creditor - Open Door Loans. They have refused to deal with me in writing and refused my repayment offer (all other lenders accepted my offers, eventually). Now they seem to have passed on the debt to Resolution Recoveries, who are phoning me every day - at work, at home and on my mobile.

I have already written to Open Door Loans to tell them I only want to be contacted in writing, which they ignored and kept phoning me. I have heard nothing in writing at all - not even email - from Resolution Recoveries, just phone calls asking if they can speak to me.

I'm not going to speak to a DCA on the phone, especially as I only have their word for it that they're chasing me for a debt I owe. Is there a template letter I can send them (I have found their address elsewhere) telling them to stop phoning me and put everything in writing? I would sent the letter I've been sending to the other creditors but wondered if that would be OK without any reference from RR?

    Hi,

What a pain in the bum! Anyhow, template letters can be found on this website:
    http://www.nationaldebtline.co.uk/
If you click on the relevant country, then you'll get an option of sample letter and then there'll come a drop down menu. I'm sure there's one in there that other people have used.
I think you can complain about these practices too, if they continue after you use the specified letters.

Try to incorporate the 'Don't call me or I'll report you' bit, the 'Revoking their right to call at your home bit' and 'don't have the legal right to demand financial records' bit from the relevant letters. Send it recorded delivery and then if they call, tell them it is being logged for the harassment report.

Ask for proof of the assignment of the debt, a full statement and their bank details. Send them a postal order for the amount you are prepared to pay each month until they give you the details. Do not allow them to set up a direct debit - you set up a standing order as you can control it. If you keep saying in writing that it is all you can afford and keep paying it, there is very little they can do - no judge will back them up in court.

Don't forget to print your name, not put your signature! Some DCAs have been known to, umm, play with documents......
