Hi everyone,
Im not sure how to start a new thread so i have kind of hijacked this one as my problem is also about BCW, I hope no one minds...
Basically i received a letter at the begining of june asking me to confirm my identity relating to an undisclosed matter. I guessed it was a debt collection company as i am currently in the process of paying off my ex boyfriends debts (which were in both our names since he has handily disappeared off the face of the earth).
I called BCW up as i couldnt think of any outstanding debts that i am not aleardy dealing with and they told me that there were 2 outstanding debts to British Gas totalling over £1700 for an address i lived at about 6 years ago. I told them on the phone that i wasnt acknowledging the debt as i didnt recall anything and they said that they would take note of that and that was the end of the phone conversation.
The following week i received 2 letters (one for each debt, gas and electric) saying that i wede them this money. I went onto this website and downloaded the statute barred letter and sent them that stating that i did not acknowlege or take liability for the debt if there was one which i dont believe there is and that even of there was a debt it would be over 6 years since i lived at that address.I then received another letter saying that they were putting the account on hold to investigate.
Then yesterday i received yet another 2 letters (1 for each amount)headed FINAL RESPONSE.
I can confirm we have undertaken an investigation into the issue you raised and have concluded that your complaint has been rufuted.
BCW act in good faith on the information provided by our clients, we were not at ANY time advised by our client of any ongoing disputes or unresolved complaint issues. In this instance we were passed an account in your name with instructions to pursue for the full balance accordingly. Your comments raised in the above referenced letter have been duly noted on our system file. We acted accordingly by placing your account on hold while we investigate matters.
We note that you consider your account to be subject to statute limitations. The first contact you had with us via telephone was on June 20th 2012.
British gas has responded by advising that your account is not subject to statute limitations and the outstanding amount of £xxxx remains outstanding dated 19th October 2006.
etc etc.....
Here is my problem...
1: i am not aware of either of these debts. We lived at that address for a year only and i cant believe that i didnt pay my gas or electricity at all. The electric is £276 and the gas is £1481.
2: How could anyone in a small 2 bed flat run up a gas bill that big in a year?
3: i used british gas at 3 other addresses since then and they have not tried to claim any outstanding monies from me, and before i moved to my current address with a new suplier British Gas owed ME money!
4: Is me calling BCW to confirm my name but saying that i wasnt acknowleding the debt consitute as contact in the way they mean it, i.e meaning that when it does reach the 6 years on october 19th this year it will not be statute barred because i called them. (i have at no point accepted liability for the debt).
They also attached copies of 2 photocopied letters from british gas to my name at the address which were both sent in 2009 with the heading SOLD ACCOUNT: OUTSTANDING BALANCE.
We confirm that there is an outstanding balance to pay on the account with ref number xxxxxxx for gas supplied to xxxxxxxxx at xxxxx address. The outstanding balance is £1481 which remains overdue and is now payable.
It then goes on to say
Start read date 03/09/05
final reading date: 19/10/2006 (i think i had moved out prior to this date)
But then it says:
Bill amount: £867.86
Payment received: £1050.85
Current balance: £1481.31
What does this mean???? If the bill was £867 and i paid £1050 HOW is it outstanding by £1481??
I know this is a lot of info but i would really appreciate any advice anyone can give me, especially on my point number 4 as above re the contact and statute bared thing.

They're really amusing aren't they? So you phoning them to say you don't recognise the debt counts as a written acknowledgement!
Continue to ignore them. Even on their dates (which are probably made up) the alleged debt is SB in October.0
