Hi
I currently rent a house out. The tenants have been in for ages (well before the deposit protection scheme came in ).
The tenants signed the original lease but have not signed any others.
Do I need to have the deposit in a protection scheme ??
Thanks in advance for any replies

If their tenancy started before April 2007 and they have never signed a renewal, then the law does not require you to register their deposit.
But it is good practice to do so voluntarily.
Are there any other areas of leglislation you are uncertain of? Read here.0 -
Thanks for the link.
I was unsure about the protection scheme, we are hopefully moving back into the property ourselves so I wanted to double check before I give them notice.
Ive just got my fingers crossed that our sale goes through ok then it's back to the old house but with alot less debt 😄

If you read this thread from LLZ, post no 7 seems to suggest otherwise!0

Thanks G_M
That link is really handy.
I am not looking forward to giving my tenant notice as they are family friends and we have been giving them the rent pretty cheap. But I have to try to do what is best for my own family and that would be moving back

To all those who say you don't need to register the deposit this is incorrect.
The localism bill changes meant that any deposits taken before 6 April 2012 had to be protected by 6 May 2012 or leave yourself open to the penalties.
