please help....bankruptcy questions

Hi, me and my hubby have decided to go for bankruptcy, we are currently in an IVA which is not working out. As I understand we go through bankruptcy as two seperate people (we don't have any debt in joint names). My husband has an income but I do not work, just get the usual benefits CT CB! Am i right in saying that they will take any surplus income from hubby but what will they take from me and how do we split which bills we both pay. Would really like to come out of all this will a bit spare to be able to do nice things with our children. I know this is all our fault, and I feel very stupid for allowing this to get this bad

You have no income from anything other than benefits, so the OR/trustee could not require you to pay anything.

Your OH may be asked to contribute depending on what he has left out of earned income when the households surplus is calculated.

Thank you for the info, that really helped. I take it when I do my expenditure form they will not ask what my husbands income is then, and will they require him to put on his what I receive in benefits?? Sorry for the awkward questions!!!!
