Can I go bankrupt?

Hi All

I was wondering if anyone can help me?

I lived in Jersey for 3 years and took out a loan. I became extremely ill and moved back to the UK but because of my illness I am now unable to work full time and so I am unable to pay the loan back. I was hoping to go bankrupt but Jersey does not accept a person going bankrupt (unless it is a company). About a year ago they put a petition into the Jersey court, the first time it was postponed and the second time it was withdrawn. Now they have put it back to the Jersey court and now I dont know what to do?? Is there a way I can go bankrupt over here and have that loan put into it? I dont have a house I am renting a room off a friend and I work part time and for this I need a car so this is the only thing I have?? Is there anyone who knows anything about the Jersey laws? or is there anyone you think I can contact to ask about this??

    OK, sorry your not getting very far, without paying for a solicitor which I imagine is your only option, try this Community legal advice

    Either that or pay to ask a solicitor a question on one of those online sites? but it will cost and I really don't know how accurate it is


    But nonetheless all stuff I guess I'd do if I really had to!!

    As far as I'm aware, you simply go bankrupt in England and Wales (or Scotland, etc, wherever 'over here' might be). Your Jersey creditor would therefore be prevented from taking any action against you 'over here'. They might not apply in Jersey, but then unless you plan going back there or intend owning any future assets there, that would be of no consequence.

    yes antrobus is correct, if you have been living here for 6 months and intend to stay then you can go bankrupt here, this effectively stops your creditors taking action against you here and in the EU. But as pointed out if you have assets in jersey or intend to go back there the jersey court does not have to uphold the bankruptcy order in their juristiction

    Just a note, if you claim working tax credit and you take your award notice, you are exempt from the 175 court fee, it will cost 525, I only found that out from this site. good luck
  • Thanks for all of your answers! I'm hoping to now go bankrupt which obviously scares me but before I do I may need to find out all the cons of doing this before I go for it (any info anyone can give me i will be grateful with) I just cant continue as I am!
