Family of 2 adults 5 dependants (1 disabled child)

As I am crap at numbers and some of these are weekly/fortnightly/monthly paid I have input them all and have the montly figure. If husbands wages (currently £850) increase the housing benefit goes down, so the overall income does not change.

Motor Insurance £50 (will increase when I bite the bullet and tell them about my recent 6 points)

Suggested Living Expenses by CCCS (included the slightly adjusted figures to include DLA for disabled child if food/clothing/entertainment figures seem a bit wacky)

    After the Debts it says either me/joint/husband. So the main loan is in his name.

    Next - £500

    = £1860


    HUSBANDS DEBTS:


    Natwest Loan £17500 Husbands name (but joint…) This is actually only HIS debt then, technically)
    Capital One - £80

    = £17580


    JOINT DEBTS:

    Natwest overdraft £1000
    Housing Benefit £750
    Oil on parents credit card £300
    Owe £1600 for sons diagnosis treatment (hopefully £1000 to be paid by healthcare company) so £600 (You need to look at this in whole, until such a time as it's actually, truly down to £600) So - £1600 is the figure we'll use for now.

    = £ 3,650


    Now - We need to look at the following, you need a true picture of these as before making any decision, you need accurate figures:

    Council Tax Arrears £465 (Who's it the debt though?)
    Water ? (Need to know this figure and who's name it is in please)

    Can you tell us who gets what money? As in, who gets what benefits as if your OH goes BR, it will be HIS income that is used towards any IPA and that may affect how much you are both left to live on.

    Ok, my advice, for what it's worth is that I would advise BR for your OH. If he also has no assests. Consider it carefully though and consider how it might affect his current job or future prospects.

    You can only get an Administration Order on your debts as they are under £5,000 but ONLY if you have at least one CCJ. Do you? I didn't see that listed on your list of debts.

    You aren't eligible, alone, for a DMP as I saw it, you need to owe £5000+. But of course you do have joint debt that might push you over that amount. If it does, then I think that yes, DMP would be best for you.

    Although, again, you might hit a snag in that you don't have much disposable income and you need to have a certain amount to give to creditors every month, for them to accept your DMP offer. Hmm.

    That 26 year plan CCCS quoted you, was that for both your debts?

    Anyway, to be honest, I'm not sure what happens to joint debt if ONE of them makes themselves BR. Someone might be along later to help you on that.

    If joint debts are halved then I'd be inclined to advise you to go BR, especially as you have such a small amount of surplus income.

    The DMP suggested was for both of us, and is now saying 34 years-so thats good!

  • Thats what i was going to suggest when i replied lastnite savage ,i think you would have to pay 2 lots of BR fees though ,one of the more experianced peole will be able to give you more advice .

    Do I have to pay court fees ?

    You may not have to pay a court fee if:

    a) You are on Income Support, or

    b) Working Tax Credit, where child tax credit is being paid or there is a disability or severe disability element and the gross annual income taken into account for the calculation of working tax credit is £15,450 or less, or

    c) Income based Jobseekers Allowance, or

    d) Guarantee credit under the State Pension Credit Act 2002, or

    e) Payment of a fee would cause hardship to you.

    f) You are in receipt of "Legal Help" from a solicitor, or

    g) You are in receipt of a "funding certificate" from the Legal Services Commission. You must complete court form "Ex160", (application for a fee exemption or remission) for each court fee you cannot pay for one of the above reasons.

    Are the court fees £150? each?
