Letter advice please

Evening all,

I need some help with a debt letter for someoen I know, There parents have recieved a letter about a debt that isnt her`s note Her`s addressed to MR <<female name>> << last name>>

This person has never had a debt to this said company but knows that this debt belongs to someone else and knows for a fact the address`e hasnt ever signed a credit agreement with this company.

Ami i right in thinking i need the template letter from national debt line requesting a copy of the credit agreement ?

Any help appreciated.
If it doesnt pay rent sell it.

    The mr/ms/mrs thing could potentially just be an error on the company's behalf but if you are certain that the debt is nothing to do with your friend, then in their position I would ignore that letter but keep an eye out for the next one and send it back unopened but marked "not known at this address".

    I think that there is a lot of talk at the moment about DCAs just randomly sending out letters to people of similar names as debtors they have on their books.

    Course, others might disagree with me but by writing to them you are volunteering personal information about yourself/your friend. I am just naturally wary about stuff like that...

    With reference to the above account, I am writing to confirm I am not acknowledging this debt.would you please send me a true copy of this credit agreement. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my credit agreement on request and this should be supplied within 12 working days. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
    Please note that under Section 189 you are obliged to supply these documents whether you are the original creditor or not. I await your reply.

    post a similar letter enclose a cheque for £1 and post off. better still post the letter off and post the cheque plus the paying in slip off to girobank bootle merseyside gir 0aa and do not write anything on the cheque apart from consumer credit agreement fee only on the back. Once this clears your account then sit back and watch how the dc go.

    Hi,

    Progress report, Got a reply today to the mail sent the day afer original post, They want the follwing before continueing They want to know the follwing... Your going to love this.

    They want proof of my friends ID,
    They want a copy of there Signature, there date of birth and there last 4 addresse`s.

    Am I right in thinking that this doesnt need to be supplied ?

    I would've thought that if it isnt your friends debt then he/she shouldnt need to be sending anything anywhere.

    Sound fishy to me. I wouldnt send anyone anything. I mean, why on earth would they need that? If it was all above board they would have the original agreement surely.

    I would stand your ground.
