ccj didnt know had sold on
Hi, Newbie here,
Was wondering if someone could tell me how to go on with this debt.
Original debt was Asda credit card. I divorced and moved and didnt keep up payments, then an agent for Lewis Group turned up at my door in 2009, i agreed £20 a month, he never came back and never left paperwork, so still paid nothing.
Sep 11, i receive letter from C L Finance saying they sold it to LLowell Porfolio, so when Llowel got in touch I agreed to pay them £25 a month, I asked for a copy of credit agreement off them and got 4 letters first saying they asking Asda for it, which i already had (Santander wrote telling me, no longer there debt, so no obligation to give me it). 2nd saying when they get it and post it to me they want full balance, 3rd saying account on hold, 4th account closed until they get it. In the meantime Ive paid them £200.
Also wrote to Lewis at same time as Llowell for credit agreement and have received this response, We are not the creditor in this matter, The creditor is CL Finance and we are there agents.
Notwithstanding the above, the agreement which is the subject in this matter was terminated prior to the issuing of County Court proceedings and subsequent entry of a County Court Judgment on 15th Dec 2008. Therefore the effect of section 78 of the consumer credit act 1974 is no longer applicable and the judgment can now be enforced should payments not be maintained in accordance with the judgment. we look forward to receiving payments.
I looked at trustonline and there is judgment there.
I dont mind paying what I owe, but not sure who, as Llowell closed account till they get agreement.
CL Finance say they sold it sep 11.
And lewis response they want money on behalf of CL Finance.
And have absolutley no court paperwork of ccj, but its on online court page.
any advice welcome please.

Im confused but could be me, how many debts is there ? Could you list who you owe money to and the amounts if you know them. You could try sending a letter asking for a statement eg whats been paid and how much is left etc.0

just one debt, was Asda credit card.
santander wrote back when i wrote to asda and said Lewis Group held debt.
C L Finance and Lewis Group are sort of same company.
As Llowell could not get agreement, I wrote to asda then Lewis, was curious as who had agreement.
and Llowell is latest debt co, who i've been paying.0 -
So I think what you are saying is that Lewis are asking for payment on behalf of CL Finance but CL Finance no longer own the debt.
So tell Lewis to get stuffed.
Lowell own the debt but have closed the account because they can't find a signed agreement, even though they probably didn't need to do that, as enforceability has already been decided (sort of, let's not go there for the moment)
If Lowell want payment, they're entitled to it and you could probably negotiate a full & final settlement deal at that point. For the moment I'd put it on the back burner because you probably have more important things to deal with.
The ccj drops off your file in 2014. If they haven't taken any action to enforce the debt by then, they'd need permission from the court to do so. It is possible that Lowell don't even know that the debt they've bought has a ccj attached to it!0
