Successful Council Tax Refund (Interest Charges)

Hi All

I have been successful in appealing my parents council tax banding and the have agreed to re-band them and back date the money from 1993, a massive 19 years incorrect banding. They were paying band F and all other houses were mainly D with some houses an E. I am so pleased for them as they are both retiring and will have to move as that bill they were getting every year is just too much.

My question is, are they also entitled to have the interest added to this money? If so how is it calculated?

    There's no interest paid - the council have billed correctly based on the council tax band at the time (as they are legally required to do) and so won't pay interest.

    The valuation office may pay if you can show they made a major mistake but its rare.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    The only times this would happen would tend to be either a dwelling clearly two or more bands higher than it should have been, or a dwelling's band not reduced when identical neighbouring ones were.

    The VOA would in any case use probably use the same response as the council, CT legislation makes no provision for the payment of interest on overpaid CT refund, so they're under no legal obligation to pay.

    Thank you do much for the advice. I do know of one property that was down banded from an f to an e, the only one in the road and they also had similar space to my parents.
