Hi there.
My post is not about asking whether or not I have to pay the money back etc because I know I do. The problem is, I dont have the money. I left my job in november last year, and for some reason the large company that I worked for payed me for the first time after leaving at the end of febuary. They have paid me every month since. This equates to around £5500 that I owe them, and I simply dont have it because I was using my bank card alot whilst not realising what was going on. The only thing I can do is propose to them that I can pay £400 up front, and up to £150 every month thereafter until the funds are paid back in full. I guess what I am asking here is just for peoples opinions on whether the company will accept this or take legal action against me? Any form of legal action would cripple my life as I have just bought a house, new job etc. I guess i dont really have a choice because I cant pay them back what I dont have. Thoughts?

Could you take out a loan to repay them? I would personally say it is reasonable for you to repay at the rate they paid you - ie over 4 months. Any chance you could get a 0% credit card for a year and pay it back over longer.0

You didn't realise you continued to be paid and didn't realise you spent an extra £5.5k over 4 months? really? I don't believe you.

I don't see any relevance in this apart from being nosey. My question was not about whether or not I should have spent it.0 -
Why do you think you should only return £150 each month, when you have spent £1300 of their money each month?
What you have spent the money on is entirely relevant - you need to get returning/ reselling these items!0 -
I find it difficult to understand how you were paid £5500 and managed to spend it, but didn't realise. Even if you are using your card a lot, it isn't really an excuse.
I don't know whether you would be eligible for a loan, but it is worth considering. However, you would have to pay interest. The only other option is to ask your previous employer if they will accept a payment plan, but I would imagine that they would want more than you have suggested. They might decide that they want the full amount up front, and could take legal action to collect what is rightfully theirs. If you left on good terms you could approach them, but if you didn't, then definitely expect them to want the money up front.0 -

You asked for thoughts and I have a few for you to choose from:
1. New poster + ridiculous story = Troll (clip, clop)
2. Unless you are a complete financial idiot, there is NO WAY you could have spent this money without knowing what you were doing - I think the company should take legal action to recover the money owed.

So assuming you "didn't know what was going on"....you did know that you were spending money? How were you planning to pay that back if you didn't think you had it in the first place? You say you used your bank card...so you must have known you had the money in the bank?0
