                    Hi  been lurking for a while,got my court date monday eek just a couple of queries i have a tax credit overpayment will this be wiped by bancruptcy i have not put it on my court papers should i or will it be wiped anyway ( single name claim ] and also i am currently on esa benefit as my only income and will be for a while will i have money taken from my benefit i think its called an ipa many thanks for your answers

            If it is an o/p that has been formally demanded prior to your bankruptcy, then it will be included.
You need to enter it on to your forms, it's in your own interests, although it would be included anyway.

Hi well they have told me i have an overpayment but have not asked for it at the moment because i am on a low income my tax credit claim ends this month as my daughter leaves school and i know then that they will send out demand for payment will it still be included in bankruptcy and thanks for the reply0 -

            Make sure that you have paperwork that the debt is quantified and they have stated that you need to pay it back.

Sorry to seem thick i have a letter saying that i have been over payed it also states what amount has been collected so far and an amount that has to be payed back from future payments but there will be no future payments so i am sure they will ask for the whole amount to be payed off but was not sure if it would be written off in BR they have stated what they have over payed in my award notice for this year thanks againdebt_doctor wrote: »Make sure that you have paperwork that the debt is quantified and they have stated that you need to pay it back.
