HELP! Ex took my financed car, now its repossessed!

Basically me and ex broke up and he took the car that I had a finance in. I had only gotten the car 15 days prior to the breakup and it was only because he pressured me into it.
He demanded he take it when we split and I couldn't afford it as I jist lost my job. He said he would change the name on the finance to his so I had nothing to do with it and I filled out forms for him to do this!
A month later the finance company tell me it's illegal for the car to be in anyone elses posession but mine so I attempt to get car back as finance is still in my name. Ex changed the owner of the car to his name without me even knowing. He would not return car to me so I tried to report it stolen. Police wouldnt do anything and finance company said as long as ex kept up with payments it was ok. Hes gone around telling everyone its his car. 5 months later the car has been repossessed from his home address and Ive recieved a bill for 7k saying Im liable despite car company knowing exactly what has happened.

What do I do? Ive driven the car literally 6 times and not seen it in 5 months! No one would report it as stolen and car company knew my ex had it and wouldnt return it Share

    Not much comfort, but there's little you can do. As the finance was in your name you are responsible for making sure the payments are made.

    Your mistake was trusting your ex.

    Did the finance company sell the car at auction?

    It is very unfortunate, but the finance was in your name so this is a very expensive lesson. You can check the T&Cs of the finance agreement, but I am sure what they are doing is correct and legal.
    Why did you get the car when you were losing your job? What sort of notice did your employer give you?
    What forms did you fill out for you ex? He would not be able to transfer the car into his name without you agreeing to this. And it is unlikely the forms were from the Finance Company as they would probably not allow the car and debt to be transferred. In this case the car was never yours to give away (which is essentially what you have done) as it belonged to the finance company.
    As for the £7K outstanding debt then you might want to question how this figure was arrived at. The finance company would want you to pay for any outstanding debts on the car, and this will be after the car was sold. Find out how much they got for the car? Ask about any deductions they have made (over mileage, damage, etc).

    Surely if you had managed to get the car back you wouldn't have been in any better a position as you couldn't afford the car anyway. Whichever way it sounds like it would have been repossessed so the rest of the story isn't that relevant.

    You need to talk to the finance company and obtain a full financial breakdown of ths debacle. Sounds like you've been well and truly had by your delightful ex partner.

    Talk to a solicitor. There is so much that someone would need to know about communications had between parties to even start to advise on this. It doesn't sound good from what you've said here but for the sake of an, often free, consultation it's worth asking someone who can give proper informed advice.
    Having a signature removed for mentioning the removal of a previous signature. Blackwhite bellyfeel double plus good...

    Cracking advice there. It sounds like there could potentially be certain things which have happened along the way which shouldn't have done, so indeed worth a shot.

    You signed the contract and that is what will be enforced.
    As the debt is over £5000 Bankruptcy could be your best option to wipe out this and any other debts you have.

    Im gunna basically lose everything. I have a mortgage on ahouse with my ex. Im still living in it and paying for it while hes trying to sell it. If I go bankrupt do I lose my home too??
  • He does not own the car

    He may be the V5 holder

    thats the registration document.

    The person who gets the points.

    It is not legal ownership.

    In law you will own this car until the finance is paid (actually the finance company do, but thats neither here nor there).

    You will need to contact a lawyer and the police.

    the police will say its a civil matter.
