Being intimidated by creditor and police

Hi there,

A person has got a county court judgment against me and I can't afford to pay him and it's only been two weeks since the judgment was given in his favour and now last night he's coming knocking on my door, I didn't open and rang the police but then he left so I told the police he has gone. Today, he has come knocking again and wasn't leaving the door, he was on his phone ordering a skip and me getting worried phoned the police and they came round straight away and got him away.

Thing is, police then asked me if I know him, I said no and then they went and spoke to him and he said he's got a judgment against me then the policeman told me that I was lying and I've wasted their time and told me that I should pay him whats owed or I'll get a court fine and if I don't they'll come and arrest me or something. What's that all about? I'm worried sick now, surely he can't do this and has to go through the court? Is there any help line? I feel he'll come knocking again

My mum is disabled and she gets panic attacks at the slightest of things, I would appreciate some advice

thanks

What did the court say you have to pay him.

Do you have to pay weekly/monthly. If not you need to sort one out.

    What income do you have.

You already have a county court judgement against you,it has already been through the courts and you have been ordered to pay, if you dont pay it, the bailiffs will be next and every time they come the charge will just get added on and added on.

You need to set up a payment plan.
You also need to think of your poor mother.

The more you ignore it the worse it will get.

    Hi

Lying to the police is "wasting police time" which is an offence - for which they can charge and prosecute you. So yes, it could be a problem.

However, they are required to protect you from haressment by your creditor.

I suggest you go to your local police station, speak to someone there, grovel like hell and promise never to waste police time again. because you may need them again.

Have you tried to vary the CCJ? Did you defend it? You need to get an affordable amount set and pay by stadnign order straight from your pay packet every month.
If you've have not made a mistake, you've made nothing

    I dont work

He owes me money but the judgment was decided in his favour

I was under the impression that he is supposed to go through the court in enforcing the judgment, not be knocking outside and hiring a skip

You should have reported him to the police, as what hes doing is harrasment. Telling them you didnt know him was a little stupid though, as you do.

He cannot harrass you as he is doing. You have a CCJ against you yes - and you need to pay yes - but he has no rights to come knocking and intimidating you - though if he does get bailiffs involded its a little diffent.

you need to first contact this guy, andoffer a payment plan as you cant afford it in one lump. TBH, the CCJ should lay down how much you have to pay - and if you could afford it in one go you should have said so - supporting with documentation - and the hearing so a monthly figure could be set.

No income apart from jobseeker's allowance, how do I set up a payment plan?

He doesnt owe you money, the judge has ruled that he doesnt owe you money, the judge has ruled that you owe him money after listening to all the facts.

Am I right in thinking that the OP should pay the court, not the creditor, and the court pays the creditor.

The court would have told you how much per month to pay him.
