Council Tax Rebanding

Can anyone advise whether I can challenge the council tax banding for a property I no longer live in? We moved two years ago having lived in a one bedroom flat for 6 years. The flat was classed as falling within Band B as were our neighbours above and next door, but having followed Martin's formula, we should have been safely in Band A.

    No you cant as you would only be able to ask for a review of your band but cant as you dont live there. The only way is to contact the new owner and get them to appeal and you will get the reband also.
  • i have recieved a response back from my council tax appeal only to find out that the previous owner had taken it to tribunal appealing against a cycle path outside my drive in 1999. this appeal showed up a house being sold for £56,000 in 1995 but on doing Martins council tax valuation it was worth £43,000 in 1991 so yes i am in the wrong band, i should be in B and not C which i am currently in, but according to our local valuations office they say we cannot appeal against council tax banding as it has already gone to tribunal once. so i now feel as though this avenue is not open to me although Martins re-evaluation is right. is there anything anyone can suggest i do?
  • I am just about to write to the current owner/occupier of the house I used to live in.

    My old council said as I was not the owner, I cannot appeal and claim any refund..if owed.

    How they can take your money knowing now that they may owe you some back and not allow you to apply is verging in dirty play/fraud.


    Lets see how a letter to the new owners goes.:rolleyes:

    The rental property we have just moved from was in the wrong band but as we knew we were moving did nothing about it as from what I read at the time as we had moved in moved than 6 months previously we were not able to do anything. But, whilst we were there we had a rebate from the previous rental . Someone who was on the ball and appealed got everyone changed to a B. That was very nice of them.
    Landlord now has the property on the market and if it sells I may well write with all the info and see if they do anything about it. The house was a D but should be a C.
    We have now bought a house - have already had a nice letter informing us that they will be reviewing the banding - C at moment. So trying to do my homework on this extension lark before filling in their form to send back to them - within 6 months I assume!!!!!! Fingers crossed.

    Really is so wrong they way it is all done.

    They didn't 'know' did they? They are the council and the VO banded the property not them,
    it's not the council's fault your band is wrong, blame the Valuation Office !!!!! :rolleyes:

    Yes you might not be able to appeal but if you contact your local listings officer and tell him you think you are wrongly banded then he will have to look into it, you may have to wait a few weeks for a reply but we did it and they wrote back saying we are now being rebanded to band A instead of the band B we were in and we have just had a letter from the council saying they owe us £568 and we just need to sign the letter to say we are entitled and they will send us a cheque.
