Debt that isn't mine and now I can't get a loan. HELP?!?

Hi, no I don't know if they were delivered, I was just going on what Lowell had said to me, they said that the item(s) would have been delivered to my grandad's house and also the account paperwork. so I MUST have known about the item(s) & store card. They pretty much could accused me of lying. Thanks for your reply0 -
NEVER call debt collectors they lie, cheat, threaten and basically BS on the phone. They don't give a monkeys who pays up even if its not the right person. There have been many cases come to light where people (espcially those who are older or vunerable) have paid up even tho its not their debt just because they panic or are scared. Everthing in writing from now on unless you can record the calls.
I would take a look over on the CAG forum where people have sued debt collectors for putting incorrect information on their credit file. My understanding is as the previous poster says you can sue for damages and as I understand it can be awarded 5k per event you can show you lost out due to their miss information.
I would also write to the debt reference agency, be very firm and point out you have already raised this with lowell, but they should be aware you hold them also responsible for the not ensuring the information is correct. Normally the debt ref agencies are awkward about removing info, and you may have to fight it out long term-consider complaints to the FSA and the data protection ombudsman. Short term equifax et al will often remove the entry whilst it is looked into. This may give you the chance to get your loan sorted.

Thanks so much for your reply, I've written out a notice before action letter for Lowell. And will write a letter to Argos HR after I have written this, I was going to phone them, but I think it would be better with a letter for evidence. Thank you so much for your help and support, its greatly appreciated. I'm with Noddle for my credit report, I have highlighted to them that Lowell is not my debt and also the unknown address to which Lowell have linked me too, hopefully I will hear back from them next week. Thanks, I've just finished typing up both the notice before action for Lowell and a letter to Argos requesting information on the account.0 -
Just an update on this, I recieved a letter from lowell about a month ago that they had investigated the account and the debt has been dropped. My credit score shot up to 3/5 and I can finally sleep at night. Thanks so much for all your help! Much love0

I would check your credit file to see if they have just "settled the money that you owed them.
It wouldn't suprise me if Lowell just wrote off the debt. What you are looking for is a notice of correction on your credit file, not a settled default.
Please keep us updated, I hope it is the latter..

Happy new year to you too, I check my credit score every month now. Unfortunatly i'm back to 1/5 as my mum decided to use an account with studio (without my knowlege) that I paid off in 2010 and havnt used since. she missed a payment and now I'm back to square one. Luckily I checked my credit score and foundout before it got too out of hand. Gutted isn't the word!0 -
Just read your other thread - could it have been your mum who used the Argos card? I know it's an awful thing to think but if she did it with Studio, it doesn't seem impossible.0

No I dont think so, the address that Lowell gave me was another, and they would have linked me to her address had she had the item(s) delivered there.0
