Help please - Newbie to MSE

Hi, I really hope someone on this forum can lend some advice to me.

I am in the process of clearing all of my debts (£7k cleared in 2 years) but the final hurdle is a £4k debt I have with Barclaycard, which defaulted in June 2006. At the time of default I had a phone call from a debt collection company and I agreed to pay the debt off over 24 months. Following on from that nothing actually happened, nothing from Barclaycard, nothing from the collection company, nothing. Stupidly I left it without chasing either company, but I really want to get this cleared up.

Financially I am now in a position to pay this off, but I have the following questions:
  • Who should I contact to arrange the payments? Do Barclaycard have a helpdesk number that can put me in touch with the collection agency?
  • Should I offer to pay the full £4k, or try and settle the account for less? I understand as this was defaulted 6 years ago it is due to be taken off my credit file. So what is the best option here? If so, in everyone's experience what would be a reasonable figure to propose?
  • In regards to my credit file/score, what would be the best course of action?
Any help that anyone can provide would be greatly appreciated.

    Others, more knowledgable, will be along shortly to help.

    But, it is my understanding is if you have never communicated/paid anything to this defaulted debt since June 2006, then this months it will become Statute Barred (6 years) and will disappear from your credit record.

    Therefore, if this is the case, do not contact either collection agency nor Barclaycard, and by the end of the month no-one can enforce you to pay this debt.

    I understand that is the case in terms of my credit file. But what about the actual debt itself. What happens with that? Is it still valid and to be repaid?

    What date did it actually default in June 2006 and have you checked your credit reports from Equifax, Experian and Callcredit.

    I would wait until the 6 year annivesary of the default date, then check the reports and then consider what action if any I need to take.

    I read somewhere that although after the 6 years the debt cannot be pursued, if there has been a CCJ then legal action can still be taken. Is that correct? Where can I find out if this became a CCJ?

    Personally I would leave well alone mate. The debt is SB so they can't pursue it and as far as I'm aware can't issue a CCJ now either.

    If there is a CCJ you should find it on your credit report.

    The default will be removed the day after its six year anniversary. The same would apply to any CCJ.

    Check trustonline to find out if a CCJ was ever recorded, there's a small fee. CCJs don't become SBd as such but if no effort has been made to enforce it in 6 years they they should have to go back to the court to be able to enforce.

    If no CCJ was recorded then the debt should be SBd 6 years after your last payment as long as you never acknowledged it in writing.

    I have checked on experian and there are no notices on that, but I will double check with trustonline.

    Assuming all records are completely removed next month, what would you do with the outstanding debt? Pay it/some of it? I don't really know what to do!
