I know it is illegal but what should I do?

Hello!

I recently just acquired a new part time job (VERY part time, its a 0hr contract :/) and had my induction day today.

If it makes any difference, the job is with the jewellery shop, Argento.

I was filling in all the usual HR forms, P46, bank details etc and came across a section that asked hourly rate of pay for the job. I had not been told this previously so asked what I should put.

I was told by the manager to put £5.50 for my hourly rate. I, however, am 21 years old and was under the impression that minimum wage for 21+ was £6.08 p/h.

I didn't bring the issue up with the manager as I wanted to research it first to be absolutely sure, in case it was a case of the fact that it was a zero hours contract that perhaps the rate of pay was lower. (I know, this sounds silly but I just wanted to be 100% before i brought anything up).

Can anyone advice what i should do, whether this is legal etc?

Thanks :D

Why would i be told to put 5.50 as my hourly rate? The manager is aware that i am 21, it just doesn't make sense to me.

    But thank you :)

Surely a reputable employer knows the law?

And I assumed that this was a forum to ask questions and find advice from others. Don't overly appreciate the tone, I asked a question. That is generally what people do on forums. If you didn't know the answer, why reply? Pretty pointless.

I'm sorry, perhaps you didnt fully ready my original post.
I wanted to be 100% about zero hour contracts; a zero hour contract may have a lower rate of pay for whatever reason. I have never had a zero hour contract and therefore wanted to check before I made myself look stupid and greedy by mentioning money that I may not have been entitled to.

Why would a zero hours have a rate of less than the NMW? Maybe it does, so ignore my posts as someone will come along and tell everyone I am wrong.

    I will delete my posts

    sorry then

I'm sure that Payroll do, but individual managers often don't. Shocking, maybe, but not unusual. Don't worry about it but check your payslip when you get it.

Thanks, that's what i was originally going to do anyway. If i have been paid by the rate of 5.50 p/h, am i entitled to claim any money i should have been paid if i had been on min wage rate, perhaps to be included in my next wage?

No reason that you should know what a zero hours contract would pay, unless you were in that business.
Doubtful that a legit company would get away with paying below, guess it's an oversight which needs mentioning, company could be fined.

If you're not paid the right rate, just contact Payroll - be gentle to start with as dates of birth don't always get from HR records to Payroll! (My work involves both HR & Payroll, so I know this, for sure!!)

Could it be she doesn't realise you are 21, in which case a 'I'm 21 so shouldn't it be £6.08' would be fine
