How can I get my tax code changed?

I am having a big issue with work at the moment with regards to tax.

I started a new job in Feb and got my first wage 12/3/12, paid weekly. Now I didn't recieve my last wage from my old job until 15/4/12 and thus no P45 until then. I gave my P45 in which had my tax code printed on it into new work days later. I realise that the new tax year can into force mid change.

However they will not update the system. I have been told they need to send the P45 off to the tax office to get a new code? I asked about getting a refund and they stated I would get one through work once the new code arrived. However it is now 7 weeks down the line and they are still waiting for the tax code.

I thought once they had a P45 they could just do it straight away? The code I have at present on my wage slips is BR the P45 has a tax code of 747L. At the moment I am over paying £20-£50 a week on tax depending on the hours I work. Once I get a rebate from work I am guessing I will be re-taxed on that 'income' too?

Can I sort out this mess myself or do I really need to wait until the tax office send a new code?

    When you didnt have a p45 to give to your new employer you should have filled in a p46 on the day you started, your company should have known this, one can be downloaded, completed and sent straight back.

    You will just have to be patient Im afraid, your tax will be adjusted as soon as the tax office send your company a new tax code which should be 810L. Shouldnt be long now,

    You wont get taxed on a rebate. On the week that it comes, you will pay no tax and also get the rebate.

    Many thanks McKneff, I remember filling in a P46 when I started my old job but that was many years ago and this is only ever my third employment. The team is very small in comparison to places I have worked before and no HR as such so had no support there.

    Will work sort the rebate etc and it will come soon, ie I will not have to wait until next April?

    Can I claim back anything from the few weeks of the last tax year, if so do I just phone the tax office? In my old job we were given a specific number to call to reach a certain tax office.

    HMRC will have given your new employer a tax code when you started. As you handed in your P45 after your first pay date it is of no use and HMRC's instructions to the employer are to destroy it. You should phone HMRC up and ask them to send your tax code to your new employer (after checking that they will have allocated your personal allowance to your new employer).

    You would have to ring the HMRC and see if you have overpaid anything in the last tax year.

    Do you have a p60 from your old employer, you should be able to work it out from that anyway.

    Ive been told by HMRC in the last few weeks that any overpayments now from the previous years are now dealt with automaticallly but I wouldnt hold my breath.

    I had to ring them as I left work last September and did not use up all my tax allowance over the full years and so overpaid and rang them. Thats when I was told that they were just waiting for my P60 from my pension provider and when they received it, it would be calculated and a cheque sent but not till June/July.

    They destroy P45s received after you've been paid!? I've often been paid up to 6 weeks in arrears for overtime and the like and if you move directly from one job to another, it can be around 8 weeks before you can hand over a P45. Why would they then ignore the information on the P45?

    Many organisations still pay weekly, doesn't give much time to process anything!

    The HMRC instuctions are to destroy a P45 only if they have issued a tax code and the P45 is given in after this, if the P45 is given in before the HMRC have issued a tax code then the P45 should be used. The following is from the Day to Day Payroll instructions....

    "Employee gives you a form P45 after the
    first payday

    If an employee gives you a P45 after the first payday take note

    of any relevant Student Loan information (see page 33) and, if

    you have already received the employee’s code from us,

    destroy the P45. If you have not received a code from us you

    should follow Steps 1 to 7 of the section headed ‘A new

    employee gives you a form P45’ starting on page 19."
