Help much appreciated.

My 1st post in this forum, hoping that someone will give some advice.

Last week I checked my Equifax credit report and was shocked to see an "unsatisfied" CCJ, dating back to 2008, registered against my name. SO I called up the county court and inquired about it. They told me it was for an over payment from my ex-employer and gave me lawyer's details.

Now a bit of background. Back in 2007-2008 I lost my job and my employer made an over-payment. When I lost the job, I moved to different city and basically during whole 2007 and 2008, when economy was going down the drain, I was moving from one city to another, literally following any hope of work in ANY city. I was not aware that my ex-employer made an over-payment until I received a letter from a bailiff in April 2008. Actually two letters - one was one of those generic "letter to occupant" letter. When I received the letter, I called up the bailiff and agreed to a repayment plan. It was May 2008.

Now in my credit report, the same amount is appearing as "unsettled CCJ" dating April 2008 (which was paid in full eventually in 2009)!

I never received any correspondence from any lawyer regarding the court case.

Can anyone advise what I can do to get this nasty CCJ removed from my file?


Since mid 2008 I have never missed ANY payment of any kind. Every bill was paid on the next day it was received or was paid by direct debt. Other than this CCJ in Equifax report, everything else is in green. Even my phone contract for this period is in green.

I was hoping to apply for a mortgage this year and this matter has somewhat dampened my hopes.


One more thing, I called the lawyer and they said that they are sending a letter to court to update the record. But I understand it will not REMOVE the CCJ?

    It's a bit late now. You accepted there was a CCJ outstanding in 2008 by what a court bailiff has told you and paid the CCJ off in 2009. The CCJ will stay on your record for 6 years from the date of judgement. At the time if you did not know of any court proceedings then you should have asked for it to be set aside. As you paid it I can't see that happening. You can update them to make sure it shows as satisfied though.

  • Bummer. Thanks for the reply. I was naive back then and didn't know that I can ask the court to set-aside the judgement. I panicked when received the letter. Seems like I am stuck with this nasty thing now.

    The other interesting bit is that this CCJ does not appear on my Experian and callcredit reports!

    My Equifax score with unsatisfied CCJ is in mid 500s (deemed "excelent" by their rating?) Should I apply for mortgage or wait till this drops off?

    Hiya, Experian tends to be the preferred credit source although Equifax is very close behind. Generally, if you're affairs are in good health for the last 3 years then this usually indicates a high level of being accepted.

    The fact that everything around your CCJ blemish also should put you in a good position.

    I would apply because it will not show on your credit file if you were refused a mortgage but merely the fact that an application was made!
