    I can't find the original letter. Going through my records I would have taken this out in April/May/June 2003 and I found a bank statement from Feb 2009 and this was a payment of £100. It was not a new d/d so it was at least the second payment. So it looks like it might not have been sb or only just.....

    Will get a copy of the ca, if they have it!! If they haven't got it can I refuse to pay any more money??? Where would I stand?

    So not statute barred on that info. Had to check, as you would be amazed/horrified how many debts that Aktiv get given are SB already when they get them. Often by a margin of days/weeks, as the original creditor offloads them to Aktiv at that point.

    You can't necessarily stop paying if the don't have a credit agreement.

    Depends on many factors..... If they reply to the request. What they reply with. If you reckon you ever signed one in the first place. If they reconstitute a copy. If you do get a copy of the original or the terms of the original, if that is enforceable. etc.......

    It's not a simple yes/no question on where you stand, but instead a judgement call depending on what you get back.
