Mobility Car Scheme early Cancellation

Hi All,
I wonder if you can help me. My wife is disabled with cerebal palsy and a lot of other complications and is a powered wheelchair user. We have enquired with mobility last year re changing vehicle from an ordinary family car to Wheelchair Accessible vehicle on medical grounds. Mobility at the time agreed and we held off and informed mobility that we did wish to change at that time but is likely that we will be changing further down the line. We phone mobility a few weeks ago and they have noted that a previous agreement was made to cancel the existing car early no problem, but this time round due to apparent internal policy changes which we were not made aware of that we now have to pay a £250.00 cancellation charge despite the medial conditioning worsening. is there anything we can do to become exempt from this charge. I had to inquire about this for a family member last year and was told Motability do have the discretion to waive the charge so I can only suggest you put all your circumstances down in a letter and ask them to exercise their discretion.
The relevant section of the handbook says:Ending your agreement early
Under the Motability Scheme you have
agreed to lease your car for the full length
of the agreement. If however, you have a
valid reason to end your agreement early,
please contact us on 0845 456 4566, or
write to us at the following address
Motability Operations
Customer Contracts Department
Bristol Park House, Bristol Business Park
Coldharbour Lane, Bristol BS16 1EJ
We will require some details from you,
including confirmation of whether you will
be applying for a replacement car. Once we
have received all the necessary information,
we will review your request and confirm our
decision with you.
Please note that if you cancel your agreement
we may have to charge an administration fee
to cover our costs. Any advance payment you
have paid may be refunded on a pro-rata basis,
less any administration fee, where applicable.
If however, we cancel your agreement
because you have failed to comply with the
terms and conditions of your agreement,
no refunds will be made to you, and you
will be charged an administration fee.
We may continue to receive your allowance
until you have paid us any amount you owe.
Also, you may not be able to get another car
on the Motability Scheme. If you have any
questions, please contact us on 0845 456 45660 -

I know someone who stopped early because they needed the money more than the car and that was accepted. He was able to get another car no problem after that.0
