Debt Collectors

Hi all,

I'm sorry if there is a thread somewhere that covers this but i am a little confused and worried (which adds up to being impatient).

I received a letter last year from a debt collectors about a debt that i was sure wasn't mine, i copied the template letter from the debt helpline and sent it off and never heard anything again.

I have since moved house and last week another letter appeared from a new company, so i copied the letter again and sent it off.

I got home today to another letter from them with details about the debt and my old address, i was sure the debt wasn't mine but i am now doubting myself, in the letter they say the account was opened in 2002 and defaulted in 2003. Is this still a debt they can chase and how can i find out further information to prove if this was mine or not.

I am not trying to avoid paying it if it is mine, but i really don't remember taking a card out or getting into debt with it, but i don't want to pay for somebody else's debt.

Looking forward to your advice.

Thanks

Today I received a couple of letters from Link confirming that all accounts had been cancelled and no further action was necessary. I was skeptical when I first decided to fight their claims with a statute barred approach, convinced they would find a way to get me.
Your advice and help on this site has saved my family from a world of financial trouble. Thank you all.
Just wanted to say I spent all day yesterday reading legal paragraphs and jargon etc etc. Contacted godebt quoting half of this and surprise surprise they have come back to me today saying "After a commercial decision we have now decided to close your file and no further action will be taken"!!

So a big thank you to all who gave me advice! :-)

I would just like to say thanks very much to everyone for the info. I sent the statute barred letter, recorded delivery. Had another couple of letters from them in the meantime, one of which offered to reduce the debt by 35%. I sat tight and did nothing, and this morning got a letter from them saying that no further action would be taken, and my file had been deleted from their records. Thanks again everyone!

This moring i received a letter from AKTIV KAPITAL that read

"We refer to your recent letter regarding the above account . We have investigated the issue raised in your letter (statute barred) and can confirm that your account is statute barred under the limitation act 1980. We have therefore taken the decision not to pursue this matter further. We can confirm that the account is now closed and you should receive no further contact from us with regards to this matter."

    Thank you for your email.

We refer to your recent letter regarding the above referenced account.

We have investigated the issues raised in your letter, and can confirm that legal action on this account would be statute barred under the Limitations Period. We have therefore taken the decision not to pursue this matter any further.

We can confirm that the account is now closed and you should receive no further contact from us with regards to this matter.

Even if it was yours, the debt would be statute barred.
