Who takes this away wen made BR.. The finance company or the or?

  • I think it depends on whether or not the OR has an interest in the car or not.

    In my case, the outstanding finance was considerably more than the value of the car so the OR said it was up to me to give it back and they were happy for me to keep driving it until then - once I'd stopped paying the instalments, the HP people came and collected it but beware if they ask you to VT it as you may end up responsible for any shortfall if you sign their forms!

    I think it works differently though if the car is worth considerably more than the finance as presumably the OR would then have an interest in it and arrange everything?

    The car) its really odd as no agreement and they rang today and said its theirs to take so confused

    Assuming that the finance outstanding is greater than the value of the car, then the OR will send a letter of non-adopt to the HP company.

    It is then down to the HP company to decide what to do. Some will take the vehicle, some will let you keep paying.
