My partner took out a loan with the Halifax approx 8 years ago, due to her splitting with her husband she could not make the payments, she did arrange to pay £5 each month and asked if it could be taken out by direct debit, this was refused, she carried on payments but, due to the problems of getting down to the branch and other things she let it slip and waited to hear from them, anyway, on thursday the 8th of march 07 she had £500 paid into her account, she received a letter the next day from EVERSHEDS (who are acting for the Halifax) stating that they had took out £500 towards her bill, my question is: Are they allowed to just take this money out? she has her wages paid in each week and this has never been touched,.. any advice would be grateful,.

EVERSHEDS are a legal firm - this sounds like debt recovery services? Was the bill related to the loan or something else?:: No Websites or Links in signatures please - FM ::0

If the current account is with the same provider yes they can. "The right to offset" is in the terms and conditions of all similar products.0
