FORMAL COMPLAINT - HARASSMENT BY TELEPHONE.
Account Number's :
Dear Sirs,
I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I am 7 months pregnant and find it incredibly stressful being harrassed like this. This morning i recieved one at 8.20am, whilst trying to et my children ready for school! The amount of calls per day is rediculous, even after i speak to someone i recieve another 5,6,7 per day! Does your company not keep a record of when you have called a person and spoken to them or do you operate on a harrass someone till they break policy??
I have verbally requested numerous times that these stop, but I am still receiving calls.
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint under the procedures set out by the Financial Ombudsman (FOS). As such, you are required to send me a copy of your company complaints procedure.
Furthermore, please note that the FOS consider it 'unfair' for you to continue with phone calls when requested not to do so. Also the OFT consider it an unfair practice for you to ignore my legitimate wishes on how to contact me, for example where the debtor requests contact only via written letter or email, so I now demand that you cease any phone calls forthwith.
Be advised that any further telephone calls from your company will be recorded.
This issue is not negotiable. Any further phone calls will be logged, treated as harassment and reported to the authorities as such.
Yours faithfully,

Ok well this is a big breach of the Data Protection Act. Can I ask who the PDL company are? You absolutely must report their conduct to the OFT. It is exactly this sort of behaviour the OFT are clamping down on right now. The more complaints they receive the better, so people like Wonga don't come up with the usual 'isolated incident' BS.LBM & Debt July 2010 [STRIKE]£19,000[/STRIKE] now - £11,619.60 Long Haul Supporter #247

Just be aware they may actually ignore the letter which happened to me with speed credit/NDR/Marshall Hoarse/toothfairy.
Their first letter was that they complied with OFT regulations and that they could contact me in anyway. I have sent another letter and they still text me and send loads of emails, luckily they didn't contact me at work and I have changed jobs anyway. The other trick they may use is that they have a paperless office and it can take 28 days to put coorspondance on a file if it is sent via letter, even if it sent via recorded delivery, however still send the letter as when they do contact you, you can complain and then after 8 weeks you can complain to every authority you can think of.Total Debt: £4610.75

Thanks for the reply I have sent the letter now and i will def be reporting them to the OFT as they are more than likely contacting other people in this way to scare them and these people may be giving over there debit card details when they dont need to0 -

Even if you've (stupidly) provided the work number to them at some point in your application, can you ban them from calling the work number??0
