http://www.legislation.gov.uk/uksi/1992/613/regulation/34/made(8) Where the sum payable is paid after a liability order has been applied for under paragraph (2) but before it is made, the court shall nonetheless (if so requested by the billing authority) make the order in respect of a sum of an amount equal to the costs reasonably incurred by the authority in making the application.0

I wouldnt pay the extra, goto court and state that you had an arrangment. Also state that yes you owe the money, however they had agreed for the payment plan and the last payment was due the end of this month. Still pay as planned, ask for the costs not to be awarded
When we originally rang up on the 8th of May, which was the first letter we had received we said look we have just been sprung this bill and we don't have that money to hand. We said we would pay 50% which we did and then the other at the end of the month.
HOWEVER!!, they never at any time agreed that this was acceptable, like i said they were very vague at best.
As CIS points out and the letter accompanying the summons states pretty much the same the court hearing is just a to show we are liable for the council tax debt, and we are. Nothing said at court will make any difference as the judge will just rule that we are liable, which is not what I am debating.
So I think the best course of action is to pay the extortionate fee rather than waste half a day sat in court for a 5 minute hearing.0 -

If you did want to go (you do have the legal right to) then you shouldn't need to spend long at the court as the hearing time is booked and should run pretty much on time however as you realise there's not a lot that going to court would achieve.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
