This is getting interesting. HH other than M&S are you happy staying with CCCS? If so, perhaps go down the FOS route as a first step. If you get nowhere with that then reconsider doing it yourself.
I'm going to stick with CCCS to see who does and does not stop interest. Once I know that will make up my mind0 -

I have been to FOS, am not going to rock the boat further at this stage.
CCCS - ish! But the alternatives are having the guts to play hardball or play poker!

Don't worry about guts HH, we're here to support you if you do decide to play hard ball, I'm sure with the wealth of experience on here they have come across every tactic in the book and have every letter to present in the game0 -

Or do you intend to go self managed, reduce M&S to £1 (tell them some story or other) but keep the other creditors at the same payment rate so your not upsetting them? That would be a plan as I suspect the credtors aren't really bothered who they get the money off whether its CCCS or HH!
Of course M& S could be bas&*^^£ and go down the CCJ route but thats something that you would have to fight IF it came about. I'm sure the darkside would help with that.
I see Gimpsdad was posting about IVA on another thread, is this something your considering?

I just wanted to comment on this post. You would keep your payments to other creditors the same as your circumstances wouldnt have changed. The token payment is purely for a couple of months to force the default/move to a debt collection agency.
Additionally, M&S could go for a CCJ but they have to default you first, then either fail to reach a negotiated reduced rate with you or agree a repayment plan and you break it. This is the reason that I enclosed a SOA with my offers, it showed I was paying what I could afford and creditors know they cannot have what you dont and that a court will recognise this (plus it costs them to take to court)
To HH - I totally understand your hesitation but I dont see what you have to lose.... If you reduce the payments they have to do something and their options are limited to accept a token payment, default and negotiate or default and sell the debt.
With regard to the comment on another post saying they were fed up responding to all the letters; you dont have to. Once you have setup your payment and they (finally) agree to it, you dont need to keep corresponding until there is a change or review needed.

M&S could go to court to ask for a CCJ, but you could also fight it and win - M&S unreasonable behaviour being a starting point. I'm sure the judge would be interested to hear why M&S decided to act in this way (i'm an M&S debtor).
Pure scum bags M&S are.
If you do get a CCJ so what? Your credit ratings trashed anyway.
PDD is right, we have all become scared of the banks and lost sight of what MSE is/was about.

Have you made any decision on this? I've decided to go down self managed myself with the help of those lovely people on the 'other' site. I read the advice there and it seems a good route since M&S are behaving badly.0
