Please help - My credit file has a mark by it, but the bank has not contacted me!

This is a very long story, but I will try and keep it short.
I split up with my partner two years ago (2010), we had joint loans (2007) together, I had to leave the family home quickly as he assaulted my daughter, domestic violence etc - this led to his arrest, court case etc.
I moved down South quickly to get away from him and to start a new life for myself and my daughter, he lives in Scotland, so no contact. I have sent letters to the bank regarding our split and giving them my new address details, etc over the years. I also requested copies of the agreement, statements etc. No one has ever sent me any of these items.
Now I have a new partner and we want to buy a house together it has been bought to my attention that against my name on a credit file company I have two payments in arrears and a gone away flag?
The way everything is at the moment, no lender will lend with this by my name? I keep writing to the bank and asking for details but no one seems interested in contacting me. I am going out of my mind as I have never ever been in this situation before. I think my ex partner, as he lives local to the bank, has may been into see them and told them I've disappeared or said something to them that they will not contact me.... He is very controlling and may be this is his way of still controlling me?
April this year I also received a letter from his solicitor saying that loans had not finished and I must start paying his client the money back. I sent a letter back saying that I have no agreements, no copies of statements and no paperwork what so ever to tell me that these loans had not finished and requested copies of everything and that I will contact the loan companies directly and pay them directly and not his client. Again, no paperwork sent back to me.
I am making myself ill with worry, I do not know how much more I can take, this is having a real impact on our lives. I can afford to pay, but I do not want to pay for something I have no control over or paperwork... and I do not want to pay my ex partner directly. He handled all the finances in our relationship so all paperwork etc is in his name/address, I just signed on the dotted line when asked to.
Can anyone advise me what to do next and how to clear my name - please and thank you

How did you advise the bank when you sent the letters did you send this recorded delivery, did you follow up the lack of correspondence with any phone calls?0

No recorded delivery - phone calls, I do not have enough information to pass over the phone. I emailed my complaint as well, which they said they would look into.0

I had to give them my DOB, name, previous addresses on an email reply.0

Ok are they aware of what had happened due to the violence in the relationship.
You may have to look at a notice of correction.
First things first is it a joint account if so he has as much say over address changes. I presume from the post you are dealing with a scottish bank, personally I'd call the call centre explain what has happened open a separate account and explain he has had problems in the past.
show them that you are willing to talk to them. If he has been doing things on the account and its a joint account you have a right to ask whats going on.
The gone away marker can be explained by your sudden move from the family home. I'd be tempted to have a chat with the bank but be ready to put a notice of correction on all 3 of your credit files to ensure that people are aware of what has been happening.
It won't be there forever but there are some remedy steps you can take.0 -

The bank has replied to my several emails a day to the complaints department and say it's under investigation and they will contact me soon.
I have no problem paying back any monies I owe, if I owe, but I want proof. I just don't like the way it's all been dealt with. No doubt I will have a fight on my hands trying to clear my name on my credit file and if I can do so?
Notice of correction - is that something I can do?
Is this seriously going to stop lenders lending me money?

A notice of correction is something you can put on your file with all 3 agencies and it something you will need to do.
Find out what the bank say first then look to apply a notice of correction if they refuse to take off the mark's.
Yes it could affect your lending thats why I recommend you look at the notice of correction. Instead of a computer looking and saying yes or no a human has to do it.
I'd be tempted to get this all written down and when you apply if its still there tell the bank and be very honest this will help but explain what has happened.
How is the rest of your credit is it all ok?
Was the account a joint account? It just seems very odd if you sent several requests to change address and none followed this up. I'd be tempted to check and ask did they ever get them, as horrible as it sounds data protection is there to help people but there are ways round it.
Though it is drummed into staff time and time again I can regularly bypass data protection with certain companies without them wanting to speak to my husband.0 -
Can the bank put this against my name only? As joint loan? I am totally confused as to what's going on and never being informed.0

Joint loan (which I thought had finished and stopped my payment). No one contacted me to say you've stopped your payment, why? Otherwise I would of paid it. The problem is, he has all the paperwork and I have requested to him and the bank to send me copies of statements and the loan agreement so I could keep an eye on things and him not having a hold/control over me. I also requested copies from him and he didn't send me anything either. I remember the loan being taken out 2007 and supposedly finished a few months back. I wouldn't of known any better if it wasn't for my financial adviser looking at my credit report and saying 'you have two loan payments in arrears'? I do not know if he has stopped paying or what, this is why I am trying to get to the bottom of it and I am doing everything I can contacting the bank concerned. Which they have said they are investigating....0

How did you make the payments? as horrible as it sounds did it go into an account and he just took the money to spite you?0
