Hi Guys,

When I was 18yrs old my father passed away at the age of only 50, he had not left a will. His estate was divided based on what the government deemed correct at the time. As a result i ended up inheriting 12.5% of the family home as did my sister.

When I reached the age of 21 I learned of the money troubles my mother had gotten into, when she cancelled me from our family car insurance policy and pocketed the money I paid to her to aid in her debt repayments. I was given 6 points by the police and enraged I left home the very next day.

2 years had passed and I had had no involvement with my mother, sister or the family home. She and my sister lived there and I rented a place with a friend.

I then started a new job working in IT, when joining the company a credit check was carried out and i was informed I had a CCJ in my name. I was shocked as I previously had had no knowledge of this; thankfully my boss overlooked this fact and allowed me to join the company.

Upon hearing this news I signed up to a credit reference agency to check my credit report and find out more information as to why I had this CCJ on my file. I was able to obtain the details of the court, who later informed me this was due to an unpaid service charge on the family home and a CCJ had been taken out in the names of all the owners of the property one month prior. (Me, my mother and my sister).

At this point I was unaware the house even had a service charge attached to it as my mother had paid the bills etc as I had been a student whilst living there. The outstanding Bill was settled around a month later. However I now have a settled CCJ on my report.

Recently my mother has been forced to sell the house as she has gotten herself into yet more debt that she has no means of repaying.

This did however mean I was able to get my equity out of the property and now have a 50 thousand pound deposit for my first place. Eger on getting my foot on the property ladder, I earlier this week visited mortgage advisor. He has informed me it could be very difficult to locate a mortgage with the CCJ on my credit report, but will makes some enquires.

I’m at a complete loss as what to do, is there any way I can appeal the CCJ. I was genuinely unaware of a service charge and had not lived in the property for around 2 years prior. I am very worried that I’m going to end up having to wait years for this to be removed from my report before being given a mortgage.

Please can anyone advise.

    How old is the CCJ and for how much?
    Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.

    Around 8 months old now. I believe it was for around £1600ish.

    It will be a default judgement, you need to file form N244 from the courts service with the details of the judgement citing you never received paper work and file the defence that you have have "no contract" with this company who sought the CCJ.
    The court was very irresponsible for granting it even without a filed defence.

    Could it be becasue: as joint owner with mother and sister of the house Willed by your father, which was sold, but this Charge against it was not paid? Contact the solicitor involved in the sale.
