    I wouldn't recommend using RDT. We did back in 2011, it was supposed to take 18 months and for us be clear of any mortgage debt (that's what they said) and they were supposed to go after the developer who sold us the property, as it found to be illegal which we didn't know about when we signed for it (2 lawyers and 3 banks in the town had all said it was legal!). Their London office told us to stop paying the IBI and mortgage straight away, however we were told by the Spanish side later on that this had weakened our position. Although we sent the house keys out to them in early 2012, they did not get the bank to do a valuation until June 2013 - lots of costs plus interest to be added to the outstanding debt then! They were not transparent in what they were doing, did not keep us informed despite emailed requests for updates, had a couple of changes in Spanish lawyer (using the word advisedly) for our case, did not do what they had agreed to when we signed up and we had to pay for the service up front. We only got a partial dacion en pago and the London office stopped replying to our emails, taking our calls. Technically we have no mortgage but we have an unserviceable debt with the bank due to the difference between the bank valuation and the outstanding mortgage amount, interest, costs, tax, IBI etc.

    we are fed up with the Spanish legal system and trying to do things the correct way and now just want to hand the place back.

    And has anybody yet in the UK been penalised for handing the keys back to the bank in Spain?

    Debt collection is an international business. If the sums involved make it worthwhile to pursue.
  • Yes we used Rdt, sold the property as the bank told us to and they wrote off the negative equity.

  • We Used RDT to negotiate, sold the property abd the bank wrote off the negative equity, all was done amicably
