I just received a letter from kensington mortgage that because i have settled the account in 2004, section 77 of the Act is no longer applicable.

Also that due to the age of my account with them, all documents have now been destroyed and they are unable to provide me with a copy of the terms and conditions

How do I pass this huddle to claim PPI and other charges from Kensington?

Why didn't you retain the documentation yourself?

There should be library copies of their t&cs for things such as ASU bolt ons, etc.

A lack of POS documentation does not automatically mean the complaint can not be considered, nor that you are at fault for not retaining POS docs (your mge having been redeemed 8 yrs ago).

Obv this post is in relation to a claim for compensation, re the sale of payment protection in respect of your mge.

That being so, why do you feel a payment protection insurance was unsuitable to you ?

How was it sold to you ? Or did you request it ?

Why did think it was suitable at the time of purchase and for some yrs later ?

What are the additional fees you mention that you believe were unjusitfied ?
