Simple Answer needed

Hello everyone

I have a very simple question that I have been searching the internet to find and it has so far eluded me, so hopefully there is some bright spark on here who can let me know without any jargon

my hubby has 2 CCJs on his file - I have one on mine - we are certain that we only had one, this was for council tax arrears (there mix up not ours) and we paid it off as soon as the court papers came through the door

We didnt even know they were on our records until weekend when we went to enquire about a mortgage

anyway, we have rang the court and they have told us what we need to do to get them removed - no problem there, that is sorted now

BUT one of them is discontinued - so what does discontinued mean??? - that is all i wish to know

Thank you for your time

Michele x

Thank you

Unless you local council is very, very unusual (it's possible I've never heard of a council who does) then a CCJ wont be used for Council Tax. Council Tax is dealt with via a Magistrates Court issued Liability Order, this doesn't go on to your credit record.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

Particularly as a CCJ is for civil matters where as non payment of council tax is a legal matter.

Discontinued means that the claimant basically withdrew their claim part way through the case
  • Hello there

I can 100% say with certainty that the ccj was for council tax in 2006

My hubby and I both work for our local government so we got to talk to someone direct

So why is a disontinued CCJ on our credit scoring??

    This baffles me

If it was then your council has used a route that practically no other council uses and costs an awful lot more for them to use (the Liability Order route costs an awful lot less and gives a lot more power to the council).

    Which council was it ?

I will try and get written proof and send it to you, I don't want to name the council because I work for them. it was 6 years ago, things may have changed since then

I'm not saying they didn't I'm just very puzzled why they used that method (greater cost and lesser enforcement powers)
