If it one of these Back to Work Companies there is more and more instances of malpractice or as the Company stated Mis-magament :D and start looking elsewhere before the Preverbial hits the Fan same as that Big Company Headlined in the Dailys. More and more malpractice is coming to light with whistleblowers now having the confidence to inform.

Better do some Jobhunting yourself at home - to save getting caught out. Good Luck.

Well HMRC is acting for an Employees Reference number which they say should be on the Pay Slip that is issued to her, which it is not. Her employers are not providing it and HMRC is saying if they are a legitimate company they should provide it to you without a hastle. She and her colleagues have asked for it and they are not providing it. They dont have an Employers Reference either.

What is also worrying is that HMRC is saying that they have not received any information on her from her employers, and have not recorded any NI payments.

Yes, the contract stipulates payments to be made on the 15th of each month.

    Thanks!!

    HMRC are talking nonsense.

There is no requirement to put even the employer's (PAYE) reference number on a payslip. It is required on a P45 or P60. An employee may have a "works/payroll number" (it's not obligatory) which can be put on the P60.

For individuals, HMRC recognise NI numbers. The works/payroll number is one generated by the company and can be used to facilitate identification in correspondence.

The fact that the employer cannot provide an employee reference number is not unlawful. In fact HMRC are confusing things if they are talking of an employee reference number when it could be confused with the employer reference number which definitely does exist for each employer registered with HMRC.

The person/company which processes payroll should know the employer reference number. They should be contacted direct on Monday if earlier requests have been to someone not actually running payroll who may not be asking for the right thing.

Thanks for the reply. That clarifies a few things, but just yesterday, the company is saying that they cant provide either an employer reference number or an employee reference number either. And they are refusing to commit to providing a P60 by the 31st of May saying that social enterprises are exempt from providing them.

It does occur to me to wonder how they or (if they) are paying the tax over to HMRC if they don't have the forms/reply yet?

I can't believe they've kept nearly two years of tax in their accounts ready to pay over!

Another organisation talking rubbish. All employers (sole traders, partnerships, companies limited by guarantee, public limited companies, or anything else I could think of including social enterprises) have to provide these P60 forms if they are deducting tax.
At what level in the organisation is this person working?
Are they subcontractors to another organisation rather than having a direct contract with DWP?

@anamenottaken: The person making these statements is the director, the head houncho which makes it even more surprising. I suspect he thinks that everyone is so desperate that no one will say/do anything. They are both subcontractors AND receiving direct public funds.

@evilm: Yes, apparently no one received P60s last year as well, and an employee in her late 40s called HMRC who told her that we have received any tax or NI under your head.

I just find it shocking that an organization receiving public funds is behaving this way. They are treating their employees this way and expect them to help the long term unemployed get back into work!!!

What to do now? Take this to employment tribunal? Whistleblow?
