possible to reclaim charges/fees on a mortgage account

I am asking this on behalf of my other half as we are still trying untangle various debts from his marriage...
to cut an extreme long story short when he left her there was mortgage arrears, his nan paid them off to leave the ex wife with a clean slate, it was agreed between them she would stay in the property as they had their son, an interest only payment of £199 was agreed on for which she got benefits for. She only ever paid one payment. She laughed that she was being charged 2 x £30 per month when the direct debits were bounced on her account. She is that spiteful she happily paid that amount knowing the extra charges she would add to the mortgage account and that chances are my other half would be chased for it despite it being joint names.
Because there was then arrears on the account there was then a £50 charge, each month £160 was added to the account in fees.
The company was GMAC now parius, not a regular bank.
are these fees legal or are they claimable back? they kept charging various fees for arrears and no payment on account all the time they had possession of it after it was then repossessed, even after it was sold...we have had no breakdown and no paperwork, it was now sold 6 mths ago or so.
Just trying to sort everything out as they sold it so low we have a 33k debt on a secured loan to trying to claw back everything we can many thanks

There are legal and there has only been limited success with people reclaiming them. The FSA did look at a few lenders but only a couple had issues.I am an Independent Financial Adviser (IFA). just an update, I have just been researching and apparently gmac were one of the bad ones, there have been successful reclaims. The fee for no payment by direct debit (even if you paid by card or cheque) is wrong, and the fees for bounced direct debits etc were excessive and for no payment that month, so all the ones we are wondering about. I will google prior to posting
