Jacobs Bailiffs - need help urgently!

Hello i really need some advice about jacobs bailiffs. Me and mypartner fell in areas with our council tax over couple years. We always paid iton time but since my partner lost his job we started to struggle a lot. thedebt was passes to jacobs bailiffs. wereceived letter from them saying that they would set up a monthly repayment plan. Since wewere both back at work we agreed to that and set up a monthly repayment of 140pounds a month. The bailiff came toour house and we made an agreement. we were paying this amount over 5 monthsand we were never late. unfortunately my partner lost his job and we couldn’tmade payment on time. we phoned them up and offer to pay half of the payment in1st and the rest of it on 10th of the month. the advisor told us that they canonly accept a full payment but as long as we pay before 11th we should be ok.so on 11th i made payment directly into their account. today we received aletter from jacobs saying that we have broken our payment arrangements and ifwe dont pay full amount in 3 days they will come in and take our stuff. we rangthem up straight away saying that we paid them on 11th and we got thd receipt. theysaid that they didn’t receive the payment till 18th and therefore we ve brokenthe arrangements so they re sending bailiff in 4 days. as well the lady on thephone said that she seen the notes in the system and said we ve been told topay by 10th not 11th. i feel very scared and feel that this is very unfair. i msure we ve been lied to about the date and the time they received the money.isnot that we dont want to pay. Because we ve been late with payment (we ve beentold that it wud be ok) they want full payment which we just dont have. As well when wesigned the agreement to pay by instalments the bailiff gave us a notice ofseizure which we signed as well. Does this mean they can force entry to ourhouse and take our belongings? Please let me know if theres anything I can doabout it, I still would like to pay monthly repayments but they just notinterested. Any advice is much appreciated. Thank you

    Before the 11th means on or before the 10th, but it is easy to get in a tangle if they used that phrase.

    What was the value ofthe liability order?

    What fees have Jacobs added to the debt?

    How much is outstanding today (after the payment made this month)?

    unfortunatly you should of got the person who said it was ok to make a late half payment put it in writing for you-- but hind-sight is a wonderful thing.
    As far as i can make out you wont be in any arrears on the account, as you paid on the date and the new agreed date, tho technically you have broken the arrangement.
    do you have the name of the person you spoke to on the phone who said it was ok?
    i would try to speak to them direct about it.

    on the levy
    unfortunatly you have signed a walking possesion, it wouldnt of mattered if you did not sign it, so the goods listed no longer belong to you, and yes, if the bailiff wants to he can force entry, with or without you being their to recover the assets.

    i would phone them up again and see what can be done as they said it was ok to pay late

    what date did you make the late paynebt? the 10th,11th or 18th
  • I ve already phoned them twice today and nearly broke down crying but they didnt want to hear it at all. I ve actually made payment on 11th directly into their account but they told me that they didnt receive the payment till 18th which i find hard to belive.I thought that if i pay it directly the money wud be in their account the same day :( Im so scared for them to come on wednesday. Im thinking to call my council to offer to pay directly to them but im not sure if thats gonna stop the bailiffs. as well im going to ask my citizens advice bureau. and that's right im not even in arrears...

    i dont think the council will take payment now its in the hands of the bailiffs but it might be wise to let them know whats going on as the bailiffs are the councils agents and are equally liable for the bailiffs actions if they do something wrong or are to be seen to be using undue pressure to pile on costs.

    tell the council excatly whats happend and stress that you were told you could pay late and they have resinded on this verbal agreement.
    get proof of when you paid and take that with you
    you could ask the council to cease action on the case and you will make the same payments to them as the bailiffs, see what they say

    it does seem to me that jacobs are using the letter of the law and then bending the rules to suit themselves in order to load charges onto you, which you wud be liable for
    try the CAB too but i wud be sitting in the councils office 1st thing tmw
    make sure you get all thats said at the council in writing or better still record it, remember to ask permission before you start to record
    get full names of anyone you speak too
