Can you get more than one DRO?

I was granted a DRO in 2009 after giving up work to care for my Mother. It would appear I forgot to include one of my debts in this DRO and they are now pursuing me for payment.

I did write to the previous company (Mercantile Data Bureau Ltd), in 2011, explaining my DRO and the fact that I now live on Carers Allowance. I offered to pay them £5/mth but received no further response from them.

In May 2011 a different company wrote to me demanding payment which, I must admit I ignored!

Now, a further company (Lucas Credit Services) have taken over the debt. They are threatening to send a Debt Collection Agent to the house which terrifies me as this is my Mother's house.

Could I apply for a second DRO to get these guys off my back?

    If you have been subject to a DRO in the last 6 years, then you are not able to enter into another.

    How much is this for? What sort of debt? When was the debt first taken out? When did you last make a payment or acknowledge the debt?

    It was an Argos card and the debt is £680 taken out in 2005. Ive already looked into the statute barred route but unfortunately, when I wrote to the previous company offering to make a payment of £5/mth, I was acknowledging the debt!

    But was there a 6 year gap during which you didn't pay or acknowledge in writing? If there was, then the debt would have been statute barred then, and still would be now.

    Acknowledgement only restarts the clock if done before the 6 years are up. If done after, it doesn't count, and the debt would still be statute barred.

    If not, then it might be worth checking to see if they have a copy of the credit agreement. If they haven't you may be able to get them to back off, or perhaps settle for a small sum.
