I refer you to my recent post on the above subject over on Pepipoo
VCS's appeal was dismissed and the tribunal (a superior court of record) made a number of important findings that I suggest will have an effect on the way that PPC's operate. Generally, we would regard it as a good decision.

My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

I see the decision takes into account the period from 05 to 09 then the normal time of 6 years can come into force from 09 to present!
I can see a fair amount of cash leaving VCS going toward HMRC.0 -

Thank you, HO, that is a good find; I have read through the entire judgment now. I think it will be very useful in that the judgment states that the parking company cannot make or enforce a contract with the motorist. Now, whether that will apply to ALL parking companies we cannot say; but it will certainly be another dart to throw at the only company currently trying it on in court, and, unless their contract provides otherwise, should lead to the striking out of all their claims.0

As has been said this is from a superior court of record (HC equivalent) which means that lower courts such as the small claims court will have to follow it. It looks to be a nail in the coffin for PPCs.
If it is appealed then the danger is that an even higher superior court of record (Court of Appeal?) will agree.0 -
what bearing does this then have on the new legislation being brought in where the driver now has to confess his/her crime ??. can he/she still be chased by these ppcs for their horrendous crimes.0
