Old loan query

I'm having bother trying to get PPI back from what I paid of my loan, The lender have stated there is no record of me on their system, the 3rd party who bought the debt say they should have the CCA but dont, and yet persist on asking me to pay the rest of the loan I had. So I want to know just where I stand, legally if there is no CCA to reclaim my mis-sold PPI(which is needed now as they claim to have no record of me), then how can they justify forcing me to pay? And again if there is no CCA then can I reclaim the monies I have paid to the third party?:(

    You will have to dig out a record something quoting the account number and then state they have to refund to that if they dont go to ombudsman

    Do you have copies of your original paperwork to know that you were definitely charged for PPI?

    Have you completed a formal PPI claim to the lender?
    how long ago did you take out the loan? and how long ago did the lender sell your debt on?

  • I have sent away the PPI complaint via Belmont Thornton, who have been told that there is no record of me on file,
    I took the loan out in 2004, and was sold to Cabot in 2007 and they put a default on my credit file, since then I had kept regular payments
    but since I sent away the PPI claim (I know it had PPI as it put my payment up a lot 11.5k loan over 5 years over 21k, and it was pre-ticked) they say they have no CCA on file which to me is strange as they purchase debts and the CCA's.
    I know if they dont get the CCA I can request they remove the default under CCA act 1974 (I think), for the ones that are thinking I'm just trying to get out of paying a debt, I'm not, because if I get the PPI I would pay off the balance of my debt.

    Default wont be removed, you will need todo a SAR. You should be aware that the money will be taken off the debt and not directly to you.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • That would be fine by me, as I have been told by a reliable source that once this has been done then the default would be removed, although I'm not 100% convinced until I see it for myself. Plus I would have some extra cash for me once the debt is paid off :D

    Your reliable source is not that reliable.
    The default will not be removed as it is a recorded fact about your account (you defaulted).
    There are exceptions but they would have to agree it was in error, but in this case it seems it was correct.
