Remove Wrong Credits from Report

Hi Folks,
Sorry first post here and I am looking for advice. Serveral years ago I lived with my brother in same house.
We took out virgin media (telewest - back in the day) under my name and he paid the bills. A few years back, I moved over and he continued to occupy the house.
It has just came to my attention that he has continued the service for 5+ years under my name and continued to pay the bills. Recently VM applied a late payment record for a for back in 2008.
Firstly, I know what hes done is wrong, but its happened for whatever reason. He has applied for a tranfers of liabilty form from Virgin Media who say they will change the account into his name from mines.
he has offered to write a letter to the credit agency explaining what has happened and mistakenly the account has been carried out in my name and it should be tranferred to to his liabilty immediatlety.
My question is, Virgin Media say they cannot backdate a transfer of liabilty, however would the credit agency remove the entries from my report is he admits that it should be under his name from 2008, etc.
Can anyone advise the bext solution to go forward as its not my fault really whats ahappened here.
Many thanks

Hi
The credit reference agencies will do nothing without the creditor informing them of any change. They only report what they are told to by creditors.
Regardless of what brother says or agrees to you will be stuck with this account on your credit file.
As far as Virgin were concerned it was your account, and it would have been you they credit checked prior to deciding to offer the account originally.
You say the late payment for 2008 was only recently registered - does brother agree that the account was paid late at some point that year?
You really needed to have closed the account when you moved out, or transferred the account to your brother with Virgin at that point, and then checked your credit files to see that the account entry account showed as closed/settled.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
HI Thanks for the quick reply.
Yeah, he agress, but the biggest problem is that due to the nature of how he was paid in his job, he has never paid by direct debit. The card payments howwver have always been taken from his account and not mine (if that helps the case).
However, he regulary paid late payment charges to VM due to the nature of the his pay dates, but from a informal point of view, the account was paid every month but only inarrears hypertheically resulting in late payments charges for 9 times out of 12 during the year.
He will right explaining that he soley had use of the services and he soley lived in the property of where the services where provided to authorising that he should be made liable against his report.
I mean I under I should have checked that account was closed when I left in 2008, but I assumed that he would have changed it over. Now basically I have got alot of missed payments (even though from my point of view the account was up to date) for 4+ years when it should not have been agaisnt me.
Virgin Media advised they will transfer the liabiilty asap as soon as they recieve the form filled out. Surley the credit agency should be able to check this and together with aletter of explanation, these should be rmeoved from my report.
Thanks again.0 -
The credit agency will only do what Virgin say to.
If Virgin say you were legally liable for the account up to, say, May 2012 then any late payments on the account up until that date will and should show on your credit file.
I would say there is no point expending effort trying to get the credit reference agencies to report something different to what Virgin says.
The only way you would change is would be if Virgin agreed to backdate the transfer or liability, or agree to remove the late payment markers, both of which are unlikely.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks Tixie for your response again.
Just off the phone to VM who have advised that it is not impossible for them to tell experien to remove the late payment markers and/or ask them to transfer them to my brother.
They have told me to write to head office with a full explanation of how the situation has arose and what I want them to do and they will me a descion at their descretion.
So hopefully, we may be able to convience VM to ask experin to remove the late payment markers. Like you said Tixie, they only take direction for creditors.
Thanks again0
